So I went out to do a little scouting yesterday (my explanation for taking my gun on a really long unproductive walk), and as I rounded a bend in the creek, about 25 yd away I see this massive brown thing standing in the water with its front end submerged in an alder bush on the bank. After the initial valve check I realized it was just a massive bull bison out on a walk about. He was a long ways from where he was supposed to be... By the time I fished the camera out of my pack he had walked a good 50 yards further, but you get the idea...

Bet ya had an oh shat moment there! Now thats pretty cool! Last year Buddies, brother, and dad went out and got a spring brown bear north of here. There was 3 other bruins out at the time but the creeks started running so they got a free pass. I am hoping to get out this spring and find one. Be something else to Tag one.

No.

I called in a herd one time (fox calling) with nothing between me and a couple of dozen irate cows but a scrawny spruce tree. I had to fire a couple of warning shots in the air to get them to disperse so I could high tail it to the truck. Generally they are pretty peaceable but I have seen what happens when they get riled.

First thoughts were.. Big bear.. too close... crap... Then the light went on... Big bull... close enough... get the camera... crap, he is headed the same direction I want to go... let him get out in front a ways.

Yeah my knowledge is they seem gentle enough but are worse than a pee-o'd off bull cow.

That is why I asked if it crossed your mind to give a chase. Looked like a nice bull too.

Yeppers, He's a real nice bull, definitely trophy material. There are two herds here that free range and the big bulls seem to range out a lot farther. Once he winded me he started putting some distance between us and I was good with that! smile

Ok, here is the question:


Example:


You own property on both sides of a currently in use railroad track. Farm field on one side and all woods and mountains on the other side of the track.

To get to your property on the other side of the tracks, there is a railroad crossing that you have and other property owners along that stretch of track have also.

Last year, the railroad that owns that track decided to PARK!! a line of railroad cars spanning the length of over 10 continuous properties so that they could not gain access to their individual properties on the other side of the tracks. The crossings were also blocked.

What makes this really bad, is that the woods in those hills across the tracks have burned in the past (Forest fires ) . With the train tracks being blocked, no access for fire fighters would be available in the event that a fire were to happen, or if someone got hurt in those woods and emergency crews were needed to get the person out.


So, what to do? Does a Railroad have the right to block access to a person's land that they never in the past did before ? Why pay Property Taxes on land that you are prevented access to ?

I suspect that the crossing is a ROW or an easement. I'd bet they can't legally block your access to your property whether there's a fire or not. If they could, it essentially is an illegal 'taking' of your private property. Just like the feds with wetlands.

Asking AK guys what to do in case of a wildland fire you can't drive to, is not going to get you answers that will be practical in NY. It's the norm here, so we deal with it all the time. My guess is that you don't have the aerial resources we do.

I would also suspect that the RR is on a ROW and that they have the right to park their trains there.

But as Spek says, they might be interested in "doing the right thing" for their neighbors, just to avoid having 10 torqued landowners standing in their front office. It would seem that they might compromise by unhooking a couple of cars and leaving a gap at the crossing.

You might start by reading the small print in your deed regarding use of the crossing.

It would be my thought that the crossing has some sort of legality as well as the access road. You might pursue that.

As far as fire goes here in BC they would be given very short notice to make available access. The initial attack situation would be from air resources probably in any case with follow up of initial attack crews from helicopter until access were made available. We also have agreements in place with railroads relative to wildfire control.

pawpincher the fox have really held their fur well this year. Closed down the last my sets today with 5 more one was rubbed a bit but not bad
