Darn access is challenging; gotta climb out a hatch, on a slate roof three stories high.... Did it once today....We will be there tomorrow painting vents and patching flashing, hopefully our presence will make them move on....

You can get yourself in big trouble removing the nest with out a permit. How about a fancy chimny cap. Something that is more pointed.

As everet mentioned, since birds of prey are protected by federal law, first stop is calling USFWS.

Then you will know what options you have that are legal and can work within that framework.

Better safe than sorry.

FIO: All non-game bird are protected except E. Sparrow, Starlings and Pigeons. Under the MBTA and enforced by the USFWS. That includes there eggs,feathers and nest also. Game bird are protected by the States they are in.

thanks for suggestion. the top of chimney is epoxy coated and slick. the wind keeps blowing sticks off chimney into roof. birds cant build...:
