Second - I have been trying to find the proper stake for these. What are you guys using? Where do you get them?

HAGz would be a good place to start .
Mike Kelly has had rod along with Rally Hess .
A few other places , Farm Tec , Fleet Farm , Goetek , some bait shops have bank poles .
Someone in the know, will chime in .

They will spin if you lift the bracket up. But when trap is inserted in the hagz bracket the bracket will not spin. Trap is very solid. For marsh rat trapping they make perfect since. I have them on mink traps just to see what all the different ways I can use them.

I guess I was thinking about a stream like situation where it's being somewhat pushed by the water flow. I've used others brackets and they spun very easily. And of course it's not always a do able thing to get a support inside the jaws in a BE set in deeper water with the little conibears
