My opinion, I wouldn't hold my breath getting permission from the Indiana Dept of Highways or the DNR. The farmer is correct. Generally in rural areas the land owner owns & pays taxes to the middle of the road, but this is not in stone. Along federal & state highways the state sometimes retains ownership. I know it sounds confusing. It is best to say what is legal in states like Iowa will get you a ticket in Indiana. Stay on the far side of fences & obtain land owner permission & you should be fine.

Thankfully Iowa stopped that rule nearly 30 years ago, the ditches were public land and IA trappers stopped the rule to need permission, I snared 131 fox in the road ditches about one year before that mess You can hunt pheasant in the road ditches too

Treedablackdog ^ I looked on MDC website and couldnt find anything on it. Thought I read that somewhere awhile back.( Maybe a Senior Moment I had.) So now I honestly dont know for sure after looking again... like interstates or major highways.
