So there are roadway ditches along back county roads in my area I'd like to set. I contacted DNR and they said to contact the transportation dept. The Trans. dept. told me it was a DNR issue. I asked a farmer and he said he owns to the middle of the road, but DNR and Trans dept say no ? Does anyone know what the verdict is on road side trapping ? -Thanks

My opinion, I wouldn't hold my breath getting permission from the Indiana Dept of Highways or the DNR. The farmer is correct. Generally in rural areas the land owner owns & pays taxes to the middle of the road, but this is not in stone. Along federal & state highways the state sometimes retains ownership. I know it sounds confusing. It is best to say what is legal in states like Iowa will get you a ticket in Indiana. Stay on the far side of fences & obtain land owner permission & you should be fine.

I trapped in IN for a few years and I would say both answers are technically right. The farmer owns to the middle of the road and you need his permission to trap the ditches. The State (and local) government has an easement to maintain the property and utilities, meaning the landowner can't block them from the property, and can not give you permission to trap the ditch. Short answer is there is no ROW trapping in Indiana.

I trap alot ditches in northern montgomery county, clinton county, and some in boone and hendricks. YOU must have the land owner permission. only the county drainage boards can hire a certified trapper to remove the occasional beaver but even then they have to have land owner permission if they are crossing property not covered by the easment.

Thankfully Iowa stopped that rule nearly 30 years ago, the ditches were public land and IA trappers stopped the rule to need permission, I snared 131 fox in the road ditches about one year before that mess
You can hunt pheasant in the road ditches too

I'm glad Missouri has it right. We can trap right away, no kill traps. No disbatch on state roads.

Treedablackdog ^ I looked on MDC website and couldnt find anything on it. Thought I read that somewhere awhile back.( Maybe a Senior Moment I had.)
So now I honestly dont know for sure after looking again... like interstates or major highways.

You can trap under the bridges, but need permission along the roadside from landowners...
