I did ask ECO, he had lots of gray areas and suggested I ask NYSP. Asked NYSP they suggested I ask Sheriff. Asked deputy, said I should get clarification from judge.

When you think of open carry you think of pistols and you are not hunting you are trapping. I am not from NY so I would have it in writing if you are allowed. You people in NY put up with a lot. JMO

Yup that was one of the gray areas with ECO, you can hunt deer with a handgun, but not a rimfire, which I would be using for dispatch. Another gray area was if I was using my atv it would be unlawful if pistol was loaded. I wanted to say well I can carry in my truck loaded but didn't want to argue just wanted to do things right. Might be easier for me to just buy a cheap little pocket pistol.

Ask 20 different LEOs, of various NY agency's and you'll get 20 different answers, so good luck with that.

The fact that you have to ask the question and don't feel safe in the answers says a lot about your current problem really. IL was the same way you could but could you was a constant issue.

Had a small town cop tell me when I lived there that "transporting a gun was curtesy allowed by law enforcement" (I moved)!


Was born in a Big City Will die in the Country OK with that!

Personally, I think the majority of LEOs don't know the law on this subject.

Here is something that I recommend ALL of us print and carry with us at all times. Especially if you are traveling or live in the blue police states.

Federal Law :

United States Code Title 18-Part I-Chapter 44§926A.Interstate Transportation of Firearms Notwithstanding any other provision of any law or any rule or regulation of a State or any political subdivision thereof, any person who is not otherwise prohibited by this chapter from transporting, shipping, or receiving a firearm shall be entitled to transport a firearm for any lawful purpose from any place where he may lawfully possess and carry such firearm to any other place where he may lawfully possess and carry such firearm if, during such transportation the firearm is unloaded, and neither the firearm nor any ammunition being transported is readily accessible or is directly accessible from the passenger compartment of such transporting vehicle: Provided, That in the case of a vehicle without a compartment separate from the driver’s compartment the firearm or ammunition shall be contained in a locked container other than the glove compartment or console.


In some places like NY, CA, IL, NJ I wouldn't even stop for gas because those people will find some way to ignore the law and charge you.

My permit says that I can carry anywhere in New York, but not in New York City. I would be more concerned with carrying concealed.

Stopped in to see are local judge for his thoughts, told me he didn't think anyone but law enforcement should have pistols...…… I couldn't boot scoot and boogie out of there fast enough.

If it isn't too expensive or difficult, I would apply for a CCW and carry the trapline gun concealed. Before I had my CCW I got different answers from various LEOs about open carry restrictions or having a loaded weapon in my vehicle between stops, now there is no issue.

I didn't read much about it, but at the end of Jan. The SCOTUS agreed to hear a case brought g by forward by the N.Y. gun owners and the NRA. I know it has to do with carry in NYC, buts that's all. Google it.

My NY pistol permit, on the front states, “license to carry pistol is hereby granted. “
On the back, states, “License is issued under the following conditions. “
1. It is revocable at any time.
2. If issued outside of NYC , not valid to carry weapon in New York City unless approved by Police Commissioner of that city. “

It also states in capitol letters, Restrictions: NO RESTRICTIONS.”

It states nothing about concealed or open carry. It just says “license to carry is hereby granted.” So interput concealed or open carry is not restricted.

One other thing, NYS pistol permits are not called concealed carry permits, they are called pistol permits.

In MI. you can open carry with out a permit, but one you step into your car or truck it is considered canceled even if in plan view. Now you need a CPL.
