First, any real lawyer would tell you NEVER to come on a public forum and discuss any aspect of any criminal case. Period.

Second, forget the chair!

He did NOT plead guilty. Go back and read the original post.

He was found not guilty. It's done !

He can't be punished for being not guilty. It was a CIVIL case not criminal. Also remember the recent SCOTUS decision in the Timbs case.

People are misunderstanding the law that is involved here it's NOT illegal to retrieve game in cases of unarmed retrieval as long as you leave your weapon on the place that you were allowed to hunt on.

I dont "bully" anyone. I do believe there is right and wrong and people should own responsibility for their actions....instead of shifting blame.

A bully will always try to convince you they are doing bad for a good reason that's how they sell in but if you look at what they are really doing it's pretty clear it's not about helping others in any way!

Has anybody ever seen that kind of behavior from Swamp Wolf he is one of the most level guys on here.

some of you need to re read his post.

I still say it doesn't matter what should be done or what the law says, if those cops were going to return your property you would have it back. They know your not going to pay the cost of getting a judge to force them to give it back, if it was ever even logged in as evidence, which I doubt. So a deputy or the sheriff decided to keep it. There are 10,000 stories of people around here who have lost property to law enforcement.

Had there property stolen, would be more like it. Does it cost money to file a motion with the Judge?

No weapons were brought onto the property, the law says you have to make a attempt to look for or retrieve a animal if it goes onto private property and that's what we did. As long as u don't carry a weapon it is perfectly legal in Iowa and no permission is needed. I've been a hunter for well over 30 years and know the law. I own a sporting goods store and have been a taxidermist for 24 years, also a baseball coach, soccer coach, football coach, 4h leader and superintendent for our county fair, board member of our local summer rec etc so no I'm not a bad person and don't go looking for trouble just a couple of people using there power and standing in my way.

Catch22, since your asking if there is a fee to file a motion I can only assume you don't know how either. what if you figure it out and then have to prove they took that property and prove it was your property. it aint gonna happen. those officers know what can and what will be done.

You would be right danny, I don't know how or how much it would cost. Just hate to see people get their belonging stole from the same people who are supposed to apprehend thieves.

I dont care if there's a fee or not. Everything is online only for filing anything including small claims which I have done before for non payments etc. The judge has a law office in a town about 15 miles away and I just got off the phone with his secretary and she said he's out today and to call back tomorrow morning to talk to him so that's what I'll be doing and go from there.

Danny, law enforcement rarely returns seized property until they're told to, holding it as "evidence." However unless the property is contraband, ie illegal on its face, they are required to return unless they have a separate forfeiture order. Any lawyer worth a poop knows this.

He was found not guilty. The charge can't be brought back. Talking about it here or anywhere else is harmless. They still have his stuff. They have a legal and moral obligation to return it. It is no longer evidence. There is no forfeiture order. Shame on them for making him seek an order. If he files a motion under the case number requesting the Judge to order it back, there is no reason it won't be granted. And it is free to file the motion on a criminal matter.
