Btw Coonriver,
You are correct and you should get your gear back due to being found not guilty. Unless the court made some stipulation about your case, it isnt the officer's decision.

Not sure about the trespass on the state lands....but on the private property it appears you are legally allowed to track wounded game unarmed...according to Iowa law.

Judge said it's the same for state land. By the way the state land is what was left over from buyouts for a 4 lane hwy that crosses Iowa that was built a few years ago.

If you where not carrying a gun and he gave you a ticket you already know he is a pain in the ---.If it would of been a game warden from here he would of gave you a fine for littering also.I hope you get your stuff back.

I talked to the judge this morning and he said I now need to file a application for return of seized property which I'm headed to the court house in a few minutes. Also found out I need to put the case number of the seized property on the application except I never received a receipt for seized property from the sheriff's department when they took my stuff.

There is more to the story with it. I asked the deputy that day if he was pressing charges or the land owner he said the land owner is. The problem is my cousins land is what we hunt on and it borders this other guys land, both my cousin and the other land owner are both multi millionaires and don't like each other the land owner lives across state from this land and my cousin lives in Colorado and hasn't been to this land for probably a couple years.

I am not a lawyer, but I was a State Game Protector, Federal Game Warden and Deputy Sheriff … but not sure how your laws read in Iowa, but in only in Ohio. What the sheriff did was confiscate your property, which in Ohio the sheriff or any other officer, can only seize your property. They must then petition the court for confiscation of the property and therefore, the judge is the only one that has the right to order property to be confiscated. Therefore you should make an appointment with the judge through his secretary or you may have to do it through the clerk of court. If you see the judge, the first thing you do is thank him for his verdict. Then tell him the rest of the story and ask his opinion and advise him you never received any notice form the Sheriff. dept. the they were requesting for confiscation, of your equipment. I Hope you have a reasonable judge. Good luck.

The case number of the seized property is docket number for your case that got dismissed.

The interesting thing about free legal advice is that people treat it as worthless. They usually don't follow it and don't have much gratitude to the lawyer who gives it to them. They think it doesn't cost the lawyer anything, so what the heck.

I've given free advice to scores of people over the years, formally, representing battered women in pro bono divorce, to informally at social events. I was lucky to get a thank you.

People just don't value it, if they don't pay for it. This thread is a good example. Or did I miss the OP saying thank you to Pass-thru?

does that also apply to .gov "goodies" handed out to everyone ?

personally, I think that has much more to do with the "Entitlement Mentality" than the advice just being free.

hmmmmm….I wonder where the Entitlement Mentality comes from?

Could it be fostered by politicians like Bernie "Free healthcare. Free College Tuition. Free this. Free that." Sanders?
