I love hunting South Dakota and am already scouting for next year, I found this spot but to get to it you need to cross a corner as shown in the picture below, is that legal in South Dakota? [Linked Image]

very frustrating to have blocks of public land ony to be accessed by a very long walk while surrounding landowner and friends can drive right up. quite the norm from many places id like to hunt !


The only place you find free cheese is in a mousetrap !

Why illegal? as long as you cross at the corner post what would be the issue then or am I missing something in that pic?

I used to trap property near Arlington, Ohio, in the midnineties, where I crossed exactly at the corner post. The farmer who owned it did too. There were spikes on the wood post, that he put in, that you could use like steps. The corner post was newer than the rest of the fence too.

You start to get into right away issues, also if you touch the corner post 2 quarters of that post is owned by the other land owners.

I would get a running start and a good jump, therefore no trespass whatsoever.
I suppose there could still be an air space issue depending on how the land is deeded.

You would be trespassing.
no one is thin enough to cross over without contacting the other owners land in some way. Think of it as where 4 walls meet you could not cross diagonally without touching one. absolutely sucks and is wrong to me. Seen a show where a guy had a helicopter take him into a hunting spot cuz the land owners around it put him in the same boat.
Talk to the adjacent land owners it may be that easy.

I remember listening to a podcast from Steven Rinella about this subject. Not sure the legalities in South Dakota specifically but I do know its legal in some.

I like to respect other land owners and if I can't access the land legally I stay off.

So the question to ask yourself is accessing that land worth the hassle.

I have always wondered about setting a trap on the exact property corner and using the iron rod-pipe for the anchor.
When I set a property corner is the monument owned legally in interest by all adjoiners?
