Feds let him go because his lawyers convinced a judge that an AR lower doesn't fit the ATF's definition of a receiver. So rather than having that become case law they stopped the prosecution.

I feel like this guy broke the spirit of the law but not the letter of it. Case is a mess from the top down.

ATF was lazy and did not follow the prescribed process for rulemaking. The judge appears to be forcing them to follow the correct process to unambiguously define an AR lower as a firearm.

Looks like a slimy deal the feds used in order to keep the 2nd oppressed. The guy had a real set of stones going up against the feds like that. They rarely lose and when they do win, you spend decades in club fed. You can bet that the ATF is not going to make this mistake again. I'm sure they are hard at work closing any "loopholes" and oppressing our rights even further.

he sold 80% lowers and had a CNC mill you could rent time on. buy an 80% then walk over to the mill and place in a jig , run program and you have machined a receiver from a forging. what was sold was not a gun or completed receiver.

if I sell you exhaust pipe for your car and rent you shop time and use of my welder and grinder and you chose to use that time and tools to remove the catalytic converter from your car. I didn't make your car Illegal to drive on the street you did.

they keep repeating he sold completed guns to criminals but then said he sold 80% receivers and you paid to build them , I would argue he probably sold no more than the number of felons who pass background checks every day in a broken NICS database.

There was no rule broken if this is what he did. You only need an Ffl if your manufacturing with intent to sell. If he only had the 80% lowers and a mill for others to work on. He himself is not manufacturing.

On another note. I noticed when he was told to stop. He stopped. When told he could resume he did. I read they got a green light call from the aft. That kind of set up burns me and should not be allowed

My question is, since a lower is not technically a "receiver" as defined by the law of the land (it does not contain a bolt, firing pin, nor is the barrel attached to it), why is one required to go through a FFL to purchase a completed one?
My next question is, how did the original ARs get away with putting the serial number on the lower and not the upper?
