Supreme court ruled Newtown survivor victims can sue Remington Arms.

I believe the case is currently being considered by a state supreme court and the SCOTUS chose not to step in at this point. So the lawsuit goes forward and if there is a ruling by the state supreme court, it can be appealed and the SCOTUS cam reconsider making a decision.

My understanding of the situation at least.

The Survivors have the right to sue the gun maker but they will not win IMO. IF I was the survivor of a car accident then I could sue the car maker.

Right.

From what I read, the plaintiff claims Remington marketed its guns as human-killing machines. Sounds like a load of crap to me, but I guess a jury will decide that one. Unless Remington settles.

Because these days anyone can sue for anything. Doesn’t make it right. Doesn’t mean they’ll win. It just makes the lawyers some money and makes the people feel like they’ve done something. Remington will likely settle out of court to avoid the press but for reasons I’ll never understand.


I keep desperately hoping that one day someone will call me "Sir" without adding "please calm down" or "you're causing a scene."

You can bet that a Connecticut jury will find against Remington. To do otherwise would not be woke !

Remington may settle if they think it will be cheaper and less risky in the long run. But if they settle, I would expect a repeat law suit the next time one of their products is used wrongfully.

I don't think Remington will want to open that can of worms. The interesting (to me) hook here is that the suit is a lot about marketing strategy. They're saying Remington marketed AR's to influence the younger crowd. They will stoop as low as possible and keep coming.


I wonder if tap dancers walk into a room, look at the floor, and think, I'd tap that. I wonder about things.....

A company that gets sued in cases like this many times will choose the out of court settlement. Much of this depends upon how the rest of the firms with similar products feel the case may go. None of these firms want not even one of these to go to court and lose so there may be pressure on Remington to settle if the case looks strong. Best to not have any winning cases on the books even if that could mean one of the companies would go down. The others may actually help Remington out over time with settlements if needed. The settlement would most likely only impact Remington, where a case won in court could impact all. Remington can also do like many companies do and that is to file and thus payments would not need to be made even if they would lose. That seems to be the current method for many companies these days.

I wonder if Coast to Coast is still in business. If so perhaps I can sue them for that nice buck I missed back in 1971 with one of their faulty 20 ga. shotguns.

That's like suing Chevy for a drunk killing someone while DUI, basically, BUT, indeed, this is about the advertising.

A rebuttal SHOULD show teens shooting black rifles competitively and while hunting.

Breaks my heart that Remington's quality plummeted after moving here.

Wow walleye101, Coast to Coast 20ga was my first gun. Basically a Mossberg 500 private labeled. Shot lots of small game with that gun before passing it along to a neephew.
