I have a piece of property and the access to it has been terminated by the individual that owns the property just before me. I requested a meeting to try and work out access that would be minimally intrusive for their property. The individual hunts his property as evident by his stand. My plan for the property will most likely eliminate the hunting of his half acre. I have secured access for him to hunt properly close by. They told me to pack sand.
According to the county, that is my access however I will most likely have to take them to court. I can retain counsel for $2,000 or fence it in and put some hogs there instead of my original plan.
I’m still on the fence as to which is the better option.

If you have a legal deeded easement through his property to yours they cannot terminate it. You are the only one who can terminate your easement. If you have this easement on your deed you don't need to go to court...you tell THEM to go pound sand.

A few bars of soap hanging in trees can really screw up a hunt. I like the hogs idea too. Sometimes they will get loose. You're too kind. A fella could have a lot of fun with a jerk like that. A brother-in-law has been fighting with a neighboring landowner over deer hunting for 25 yrs. I think they both enjoy it actually.

Easement and egress laws vary state to state, check yours out but I tend to agree don't give an inch or else you will regret it

How in the heck can you hunt a half acre? That wouldn't even be legal in many areas with setback rules. From the lay out the deer are most likely coming out from my property to his corn at the corner of the two properties.

In my state, if you have had uninterrupted access for 20 years (maybe it's 21), you automatically have an easement. Google "prescriptive easement" and how your state handles them.

I live on 3/4 and wouldn't feel safe discharging a firearm unless I was shooting straight down.

You could always drill an oil well on your property about 25 yards from his deer stand... and of course the drillers won't be able to get in there until deer season starts. And they will probably be there for 90 days. Then you got to the other place you secure for him to hunt.

I should contact an attorney and have them send them a notice I will be using the access. Hopefully when they show it to their attorney, the attorney will advise them they will lose and to just grant me access. this is 100% correct, it is not the County's job. if you have a legally established and recorded easement, contact an attorney and continue use of the easement. If he has half a brain, he won't take it to court.
