For any who were wondering, I have clarification from Ontario MNR
The snare can be set in open water, but must be fully submerged and must incorporate a snare lock
Thanks to all for following and offering advice, I think I may have some specific applications where this may work, stay tuned for late October...

Crit, I think one could reasonably assume that the snare must be set in a way that would immediately submerge and drown the animal... similar to the foothold reg

Just for clarity, here is the response - verbatim
"WMU 94 is located in Part 1 of the Suspended Snare Trapping Regulation Plan where the use of snares is not permitted. There is an exemption for snares set under the surface of any body of water. The snare must be set completely under the surface of the body of water and the snare must be equipped with a snare lock."
