Been doing some digging on ND spring rat trapping. Seems like ROW trapping is not legal, and you need permission for anywhere except in state highway ROWs? How are you guys running hundreds of floats if you need permission everywhere? Am I missing something...?

Im thinking if the land is posted, you can not trap it on state highways. And yes all private land trapping need written permission to set a trap. When I trapped yrs ago I printed up permission slips for the land owners to sign. About 25% of the land owners signed. The other ones said if a warden checks you tell them to come talk to me.

Well I trapped In ND and I could trap all state and federal rows with out land owner permission.And In the counties I trapped the county DOT superviouser told me I could trap all the county Rows without land owner permission.
And I never had any land owner permission slips either and the warden never ever asked for any.

I had verbal permission on all privet land but no on ever signed any permission slip. The warden told me If some one complains to me then I'll come see you. He never did.

I followed the law and got written permission and had it all in a book in the truck. I saw NO exceptions in the laws for trapping along state or federal roads. The land is private and most that run the roads and are running floats are not following the law. Unless the law has changed since 2013.

Well trespass is a complaint law, I always gave the land owner the option. Most said they didn't need to sign any piece of paper.. It's my land and if the warden needs to have a conversation send him my way.. that's good enough for me.

The DOT supervisor is wrong, Land that is posted in N.D. is posted to the middle of the road. It doesnt matter is your hunting, fishing or trapping. And its the same on State highways. If the land is posted its posted to the middle of the road.

Well I'm going to take the word of that supervisor because I had the warden talk to him over that matter. He did mention that all counties didn't work that way.
He said that they could site the framers for planting right up to the road edge and between the power poles but figured It wasn't hurting anything.
The only time I ever saw a no trespassing sign was when deer hunting season was about to start.

And I'm also going to take the word of the warden that I could trap the state rows with out permission. I believe that to be the case because I never saw a no trespassing sign along those state rows.
We did get permission on all the town roads we trapped.

I discussed this issue specifically with folks at the State FWP headquarters, They said State and federal road ROW are owned by the state and feds respectively and can therefore be trapped without permission. All other roads are county and city maintained and are owned by the adjoining landowner UNLESS the landowner gives that property to the state (rare). Those sections are marked with signposts as state owned. In SD these roads are publicly owned.

Before I even set a trap In ND I did my research. When contacted the DOT people they even laid out the areas where they were having problems with rats.

I probably wouldn't have posted to this thread If I was still planning on trapping In ND. LOL

I'm sure the ROW along those roads is still open to trapping

Are you sure there is still water in the ROW in many to most of those spots you trapped?
