Had reason to think on the ownership of my states trapping assoc. Don't have an answer so am turning to the experts here. I assume trapping associations are non profit entities formed under the rules of the state they are in. Once formed, who or what, owns the assoc.? Are there IRS rules for trapping associations? Does someone in the association have to file paperwork annually. Fill us in!

Generally they are corporations with articles of incorporation filed with the state. These articles will define ownership whether it is entrusted to a board of directors or shareholders or membership. Also there should be a set of by laws that govern that way the corporation operates.

There is always IRS implications and paperwork depending on the structure. Structure also defines what they can and can not do based on the IRS rules for various categories.

In NC, we are a non profit governed by a Board of Directors elected by the membership according to a set of By-Laws. Although we are non profit, donations to our association are not tax deductible for the donor but we can lobby and work to get regulations changed without restriction. But if we raise more than a certain amount of money in a year, we come under another set of rules and reporting requirements.

I suspect almost every state is somewhat different.
