Look up the legislation and you likely have a section which addresses trapping for protection of property e.g. nuisance raccoon scenario. Also see if there is a definition under agent for owner.

However, I also agree the best way to ensure you are not in breach of the law is to contact one of your local COs.

Under most Provincial laws (if not all) the onus is always on the trapper to show compliance.
