They dip test tanks at the cattle sales here on sale days. I believe a search warrant would be needed. I have heard rumors to this affect but have never seen it, and I have been to the salesbarn alot. No warrant needed in Michigan. I have log/farm plates on our mill trucks. But our bulk landscape mulch haulers when pulled over get the glass straw dipped in the fuel, it better be green fuel without log/farm plates.

POV is not the same rule as commercial vehicles. If you want to co operate, farmers here have two tanks. One in the back of the pickup for fueling farm equipment or dozers or whatever. they run a fuel line out of it to the engine. The stock pickup tank has a few gallons of taxed diesel.

The DOT can do a spot check anytime they want right wrong or indifferent that’s the way it is, I believe here in Iowa the fine is however many miles are on the vehicle times the road tax, also I believe red fuel is about 3.12 a gallon here. Only write what you know to be true, Illegal search and seizure, is illegal search and seizure . no warrant, no lookie, UNLESS you give permission

Seems crazy huh, think of all the gas that goes threw lawn mowers, 4-wheelers , gas tractor's.

Just trying to understand. “They” usually ask… but they don’t have too. When the vehicle is registered as off road or on road you give permission for “them” to inspect the vechile. They can’t search the vehicle for other items, but ORD in and on-road vechile would be something they could find. Your 5 kilos of meth no, that doesn’t have anything to do with the inspection, now if they call a trooper and he or she finds it? But they, then had probable cause, because they were looking for other things. (INAL) so maybe they can’t . Usually they have a reason and aren’t just trying to mess with people. But they will and can. When I was working for weights and measures, I could check your equipment without warrant. All I needed was to suspect you were using a potential commercial device or offering ir exposing for sale a commodity.

They opened it and checked, it was explained to me that they have the authority to enforce the laws of the public right away and they have the right to check the fuel at their discretion, it falls in the same category of I want to scale you to make sure you are legal weight even with no signs of beginning overloaded. Yup.

lots of tractors in town a few people drive them instead of cars used to be an old guy with a cub cadet lawn tractor , had a rack on the back for his oxygen tank he drove around town on that , used to be not to uncommon to see 2 lawn tractors parked in front of a bar I think they eventually got asked to park in the back the front was main street , there was a kid with a farmall H a couple years ago think her was 14-15 he had a trailer behind the tractor his sisters would ride in him and his sisters would run errands , just stay off main street and no one minds every other street in town is an atv trail any way. besides it leaves less mess than the buggys who never pick up after the horse
I knew a guy who was over 18 and no drivers license. He drove a riding mower all over town. Even took his girl friend out to the bars. He'd have her in a chair in a trailer behind the mower. You'd see the mower parked right out front of the bar which was a state hwy. Only 2 places in my area that sell off road. On is a big truck stop about 10 miles away and the other is the small convenience store in the small town I live just outside of. I buy it at the local place. Never seen another person buying the stuff other than me. I just buy 1-2 5 gallon jugs at a time for a small tractor.

Farmers here have bulk tanks. Get contracts to have it delivered. KS is not using exhaust sniffers. At least not yet. Have not seen anybody under a pickup looking for an extra fuel line/ pump either. I have been pulled around behind the Olathe scale and had them put a test strip in my semi tanks. Never had them inspect my truck. They usually reserve that for out of state OTR trucks. I only cross it if I am empty. Have been stopped inspected and weighed on the side of the road many times. About 4-6 times a year.

Next time ask them what law gives them the authority to search your vehicle without a warrant? I have read everything on the Wi. DOT website about colored fuel that I could find, It mentions when not to use it and in what not to put it in and the whole array of fines and such, but no where did it void the 4th ammendment. I am not trying to be thickheaded, just would like to see an ordinance, law or anything official that says its OK. I understand it is being done or has been done, If I am asked, the answer will be, Not.

I would say no too if I drove a diesel pickup.
When I am in my semi I am not sure if its legal to check without my permission or not. I know I wont object. This is is not a joke. I guarantee you a brand new truck and a brand new trailer will have something a D.O.T. officer can write a ticket for. I don't need the problems. It's like refusing to help them inspect. You do not have to push brakes or operate lights and signals for them. If you want put out of service just go ahead and refuse. If put out of service, and your truck is towed to a repair shop, and if they are honest and say the out of service was a mistake, D.O.T. does NOT pay for towing. It is just a mistake. After all the inspecting officer is not a technician.
