^^This should certainly be the case, assuming we have Justice System left where one is innocent until proven guilty without a shadow of a doubt. The standard isn't "without a shadow of a doubt." The standard of proof is "beyond a reasonable doubt." Big difference. Jim Jim, Good to have an educated opinion on this. Way to much random speculation and assumption going around. Is there any charge that will likely stick?

That criticism of the police and National Guard is totally misdirected. They could have, and were certainly not afraid to, put a stop to this nonsense early on before things got out of control. These riots, looting and destruction of businesses and personal property are squarely on the backs of the liberal mayors and governors that ordered the police to stand down, and did not immediately activate the National Guard.
I agree the ones that were scared were the police chief and the head of the national guard (so governor guess) i didn't mean to imply every officer or soldier was scared but if the leaders were then follows the rest. Just a guess on my part but if LEOS were told to stand down but chose not to...........I suspect they would forfeit their qualified immunity. I can't see many of them going that route. Guaranteed prosecution these days. With the NG there is no question they would have been disciplined if they disregarded the stand down order.

No matter how it comes out, he was a kid, out looking for trouble. He loaded up weapons and drove a half hour to go look for trouble. He found it. He should not go completely free because of this. What gave him any less right to be there than the rioting thugs? And then there was silence!!

I'm thinking he's going to get off on Withdrawal with Prejudice if the jury tries to convict him. The ADA lied to the judge about that video compression and the judge ain't gonna like that.

Jim I don't know where I came up with withdrawal, I meant mistrial lol. I posted on the other thread a copy of the Defense's motion for mistrial with prejudice.

Jim As good as this judge seems to be he sure hems and haws on actually doing anything other than fuss at the prosecution. Binger seems to know it too and has bent the rules all the way. I get the feeling Judge Schrader is betting on the jury returning a not guilty to save him from having to issue a directed verdict or mistrial.
