Heard about a company that made pb and j sandwiches without the crust, didn’t think of a patent because it’s pb and j. Smuckers got a patent, sent a cease and desist to the original company and started making uncrustable sandwiches. Totally screwed the first company out of their business. If true, that’s dirty

What you're describing can be patented and not infringe on the original patent. It's called a use patent and is used when you take an existing item and improve or make a significant change to the design. Now if it is a brand new thing and the original inventor hasn't had the chance to update the product I would call that dirty but it wouldn't be illegal but if it is a product that has been out there for a long time and even gone through several changes it can still be improved on to as people say make a better mouse trap then I would say go for it.

Well that's not how patents really get issued. There is a lot more than just being the first to apply for a patent to actually be issued a patent and several types of patents. Not saying a well financed company wouldn't try using intimidation tactics to establish a market share advantage.
