He has not yet been charged. Wait to see what happens. It is NY so there is certainly reason to be concerned, but no reason to react when it is still being investigated. The news services, even Fox, are not reporting the events accurately. On one hand they say that the homeless guy was threatening to harm people, but then don't repeat that when they show the video. They are just creating fodder for riots which will give them something else to cover.
