ALBUQUERQUE, N.M. (KRQE) - A federal grand jury has indicted the five Amalia compound suspects on firearms and conspiracy charges. 

In addition to the firearms charges, the indictment, which was filed Tuesday afternoon, alleges "the defendants established a training camp and firing range in Taos County, where they stored firearms and ammunition and engaged in firearms and tactical training as part of their common plan to prepare for violent attacks on government, military, educational and financial institutions." 

The group was arrested last month after authorities raided their compound in Amalia and found 11 malnourished children and the remains of a 12th. They also found 11 guns and large amounts of ammo. 

The five are scheduled to appear in federal court on Wednesday to be arraigned on the indictment and for detention hearings.

AntiGov, yes on the state child abuse charges. That same week they were arrested and charged on federal guns and ammo crimes because of the illegal alien woman living at the compound and have been in federal custody since. Their initial federal court dates have been pushed back twice already to allow more time.

I'm pretty sure these folks were up to something nefarious. But what exactly is a crime with having weapons, ammo, and a firing range... And "tactical" training?

Serious question. Not being a smart aleck.

If all that stuff is a crime then a lot of folks in this country are in serious trouble... Unless those crimes are in conjunction with other offenses... And that's always a bit of a reach anyway.

Mike, at least one of the older sons told investigators they were being trained to shoot up schools. Then they found a journal indicating targets like a hospital amongst other places.

They were not going to open a deli that's for sure!

Now we're getting somewhere. So they for sure had a semblance of a plan.

It tends to raise a few flags though when someone is described as having multiple guns, ammo, and a firing range... Last I knew that still wasn't a crime in most places.

Exactly Mike, the part that says "the U.S. Attorney's office stepped in, arresting them on federal gun charges, saying the group had lots of guns and ammo and had set up a firing range" makes no sense at all. The charges should be conspiracy. I can't see any basis for weapons charges. Fox this morning said the weapons charges were related to taking guns and ammunition across state lines. That makes no sense either because people with guns move from one state to another and it is perfectly legal. If they are being indicted on federal gun charges there must be another basis other than what is being said in the news.

I always love on the news when they say the guy had a thousand rounds of ammo at his house, just an amateur really! LOL

EdP, i think the gun and ammo charges stem from an illegal immigrant in possession of firearms and ammo. They all should have several conspiracy charges - Child abuse, child abuse resulting in death, acts to commit terrorism, kidnapping, & other conspiracy charges.

I can explain this one as I worked on an ATF Task Force for almost 9 years. The law or federal statute for which is the basis for the Feds stepping in is the Possession of a Firearm by a prohibited person. They were not citizens of the US and that falls under the same Federal Statute as Felon in possession of a firearm. Ammunition can not be possessed by non citizens either. The USC Code is 922(g). There are 9 instances in which persons are prohibited from possessing a firearm or ammunition.

The part about the ammunition and firearms crossing state lines is what they charge in the indictment, It is referred to as the interstate Nexus. So, neither the firearms nor the ammo were produced in New Mexico. This too can be a separate indictable charge.
Most likely they will also be charged with one of the anti terrorist laws since they have recovered the writings from the compound about specific targets they were planning on striking.

Just in: the judge is deciding whether or not to keep in custody since they have pled not guilty. The hearing started at 1300 mountain time

I hope any foreign Hunter that decides to come the land of the free to spend money and take game is aware that our FBI equates them with felons and disallows the possession of firearms or ammunition.
