Right-to-Carry Takes Effect In National Parks

On February 22, a new law took effect that applied state firearms laws to national parks and wildlife refuges across America.

The implementation of the new law, which the National Park Service (NPS) has planned for since passage of H.R. 627 last May, has so far been without major problems. NPS management reports that it has worked with the 493 individual parks, promoting a consistent message on several key points:

Under the new law, every park is subject to all the firearms laws of the state (or states) where the park is located.
Park visitors must know and obey state laws, including knowing which state laws apply in parks (such as Yellowstone) that cross state boundaries. (For information on state laws, go to www.nraila.org/gunlaws.)
The new law affects firearms possession, not use. Laws regarding hunting, poaching, target shooting or any unlawful discharge remain unchanged.
It will remain unlawful to carry in certain locations, under a separate law that prohibits possession of any firearm in a "federal facility."
U.S. Supreme Court To Hear Oral Arguments In McDonald v. City of Chicago Next Week: As we reported last month, on Monday, January 25, the U.S. Supreme Court granted NRA's motion to allow it to participate in the upcoming oral argument in the landmark McDonald v. City of Chicago case.

Second Amendment March On Washington Scheduled For April: There will be a Second Amendment March in Washington, D.C., on April 19, 2010, from 10:00 a.m. to 4:00 p.m. Attendees will gather on the northeast corner of the Washington Monument grounds at 10:00 a.m., and the entire event will take place there (due to logistics, the event will be more of a "rally" than an actual march).

ALABAMA: No-Net-Loss Legislation Passes House of Representatives Last week, House Bill 330 passed the House of Representative 95 to 0. HB330 will now move to the Senate. HB330 would require that the state maintain at least the same amount of available public hunting land that currently exists. It requires that additional lands be opened to hunting if land that is currently open to hunting is closed. Legislation to Repeal Ban on Short-Barreled Rifles and Shotguns Advancing! House Bill 2 passed the Senate Industrial Development and Recruitment Committee on Wednesday, February 10 with a unanimous voice vote. The bill now moves to the full Senate for consideration with in the coming weeks. Sponsored by State Representative Jeremy Oden (R-11), HB 2 would amend the Alabama statute that prohibits the possession, sale, receipt, or use of rifles with barrels less than 16 inches long and shotguns with barrels less than 18 inches long. These firearms are already legal under federal law when properly registered. ARIZONA: Right to Hunt and Fish Amendment Takes a Step Forward! HCR 2008, Arizona's Right to Hunt and Fish Constitutional Amendment, passed out of the House Military Affairs and Public Safety Committee (MAAPS) on Wednesday by a vote of 6-1-1. Whether sportsmen want to believe it or not, the threat is real and NRA is laying the groundwork of our defense against future attacks with meaningful constitutional amendments such as HCR 2008. Hunters are America's true conservationists. No other group contributes more in order to preserve and reestablish wildlife populations and their habitats. It is time that hunting receives the highest form of protection available and that is what is provided in HCR 2008. The emotional cries of the animal "rights" extremists cannot be allowed to dictate the future of Arizona's wildlife policies. If passed and approved by the voters, HCR 2008 would make Arizona one of nearly a dozen states with such a constitutional protection. Concealed Carry Reform Bill (HB2347) Moving Forward! Last week we told you that State Representative Adam Driggs (R-11), Chairman of the House Judiciary Committee, was refusing to release House Bill 2347. After extensive conversations with Chairman Driggs, he has assured us that he was simply holding the bill in order to work with the bill's sponsor to consider how amendments which were being drafted would affect Arizona's law-abiding gun owners. Chairman Driggs released the bill from his Committee on Monday, February 22 with his full support, so please contact your State Representatives and ask them to support HB2347. Contact information for your State Representatives can be found by clicking here. We understand Chairman Driggs' desire to know the final content of this bill before releasing it from his committee. Chairman Driggs has been a consistent champion for Second Amendment rights and a friend of the NRA.

Hostile Amendment Added to Another Constitutional Carry Bill! Last week, during the Committee of the Whole (COW) debate on Senate Bill 1102 (legislation to clarify the legal carrying of firearms), State Senator Ken Cheuvront (D-15) added a hostile amendment, by a vote of 15 to 14, which would prohibit the private sale of firearms at gun shows, unless the seller asks for "proof of citizenship." The amendment is an unnecessary imposition on lawful private party transfers and heavily flawed. As drafted, if the purchaser presents an Arizona Driver's license issued after 1996 or a photocopy of another state's driver ID card, the purchaser would meet the "proof of citizenship" requirement. The main problem with this amendment is that it arbitrarily and unconstitutionally forbids eligible purchasers from obtaining firearms at gun shows and conscripts private citizens to enforce a flawed understanding of state and federal law. Under this amendment, non-citizens who are legal residents of Arizona, who can serve in the military and enjoy all the protections of the Bill of Rights, would be unable to legally purchase a firearm in their own state. At this time SB 1102 will be held, but there are still other bills pending that would accomplish the same goal of fully implementing Arizonans' right to carry firearms for self-defense. U.S. Forest Service Releases Plan Restricting the Use of Motor Vehicles in the Kaibab National Forest
The U.S. Forest Service released a Travel Management Project (TMP) for the Williams Ranger District within the Kaibab National Forest. The TMP will determine the future use of roads and trails for motorized access into the forest and can be viewed on-line at http://fs.usda.gov/goto/kaibab/projects.

Public comments are being accepted until Sunday, March 7 and can be emailed to: comments-southwestern-kaibab-williams@fs.fed.us or mailed to Martie Schramm, Williams District Ranger, 742 South Clover Road, Williams, AZ 86046.

The TMP will affect what is labeled as Motorized Big Game Retrieval (MBGR). The TMP states that motor vehicles could be allowed within a specified distance of certain designated routes and within specified time periods solely for the purposes of retrieving a downed big game animal by an individual who has legally taken that animal. However, motorized off-road travel for other hunting activities, such as scouting or accessing a favorite hunting site, would not be allowed. Any game retrieval that is not specifically allowed in the final TMP would require non-motorized methods.

Four management alternatives are described and all address MBGR. Alternative 1, the No Action Alternative, would allow big game retrieval to continue to be allowed across the Ranger District. Alternative 2, the alternative supported by the Forest Service, would allow MBGR with restrictions. Alternative 3 would increase the MBGR restrictions. Alternative 4 would prohibit the use of motor vehicles for MBGR off the designated road system. The TMP addresses the impacts of the alternatives on camping as well.

It is important for those sportsmen and women who depend upon the Kaibab National Forest, and particularly the Williams Ranger District, for big game hunting to review the TMP and comment on the four alternatives. The Forest Service needs to know how the alternatives would affect your ability to hunt on these forest lands and which of the alternatives, if any, you support.

The Forest Service will be hosting two meetings on the TMP. The first will be held on Wednesday, February 24 at the Williams Ranger Station from 6-8 p.m. and the second will be held at the Williams Recreation Center (301 W. Railroad Ave., Williams) on Saturday, March 6 from 1-3 p.m. For further information, please call 928-635-5614.

DELAWARE: Governor Signs Right-to-Carry Reform Bill! NRA-ILA is happy to report that Governor Jack Markell (D) has signed House Bill 258 into law. HB258 will extend the validity of a concealed carry permit from 2 years to 3 years for initial licenses and 3 years to 5 years for renewal licenses. FLORIDA: URGENT! ** ROUND 3 ** HELP Us Protect Gun Owner's Trust Fund Money Senate Bill 1158 by Senator Charlie Dean (R) has been scheduled to be heard on the Senate floor Tuesday, March 2, 2010 -- opening day of legislative session. SB-1158 is a bill to STOP legislative raids on gun owner money in the Division of Licensing Trust Fund -- that Trust Fund holds funding to administer the Concealed Weapons & Firearms Licensing program. Last year the legislature tried to take $6 million from the Division of Licensing Concealed Weapons and Firearm Trust Fund that is intended, by law, to be used solely for administering the concealed weapons and firearms licensing program. GEORGIA: Right-to-Carry Reform Bill Taking Steps Forward! Senate Bill 291 was reported favorably out of the Senate Public Safety Committee last week. It is now en route to the Senate Rules committee where it will be placed on the calendar for a floor vote by the full Senate. SB291, sponsored by State Senator David Shafer (R-48), would allow a person lawfully licensed to carry a concealed firearm the right to carry while dropping off or picking up passengers at an airport or airport facility. Also included in the bill is a provision that would make the license renewal process much easier by basically creating an automatic renewal. Instead of the licensee having to remember to renew, the probate court will be required to send out renewals 90 days before expiration. HAWAII: You're Invited to Attend the Hawaii Rifle Association's Annual Meeting on Sunday, February 28! This Sunday, February 28, NRA's state association, the Hawaii Rifle Association, will be hosting its annual members meeting at the Kokohead Shooting Complex at the "LIFE" shooting bay (first action shooting bay). The meeting portion of the day's activities will begin at 12:30 p.m., however HRA members are invited to join in the shooting festivities beginning at 9:00 a.m. Lunch will be served from 11:30 a.m. to 12:30 p.m., and after the annual meeting, the shooting events will resume. Attendees will hear from HRA officers and members will have the opportunity to elect board members. HRA membership will need to be verified prior to voting in the proceedings. KANSAS: Important Self-Defense Bill to be Heard in Kansas State House Last week, the House Judiciary Committee passed House Bill 2432, a bill making important corrections to Kansas' current self-defense statute. KENTUCKY: Right-to-Carry Reform for Military Personnel Takes Another Step Forward The Senate Veterans, Military Affairs, & Public Protection Committee passed House Bill 19 and it is currently on its second read in the Senate Rules Committee. Sponsored by State Representative Fitz Steele (D-84) and State Representative Bob Damron (D-39), HB 19 would allow military personnel who are on active duty to renew their concealed carry licenses early and via mail. It also allows for those military personnel whose licenses expire while on active duty to renew licenses within 90 days after the end of their deployment, with no late fees or other penalties. MISSISSIPPI: Make Your Voice Heard Against "No Hunting Zones" in Rankin County Late last year, the Rankin County Board of Supervisors passed an ordinance prohibiting the discharge of a firearm within 500 yards (more than a quarter mile) of a platted subdivision, or hunting with a bow within 100 yards of a platted subdivision. The ordinance was passed with little notice or opportunity for affected landowners and sportsmen to express their opposition. State law already makes it illegal to discharge a firearm into a dwelling. The effect of this far-reaching local ordinance has been to create large "No Hunting Zones" that extend far beyond subdivision property lines into neighboring tracts of land - without regard for the property rights of those landowners or for cases in which firearms could safely be discharged on those properties with absolutely no threat to neighbors. NEW MEXICO: Legislature Adjourns For the Year The Legislature adjourned sine die from its 30-day budget session last week after having passed NRA-backed Senate Bill 40. Authored by State Senator George Munoz (D-4), SB40 would allow concealed handgun licensees to protect themselves in restaurants licensed to dispense beer and wine. Your phone calls and emails helped make the difference! SB40 now heads to the desk of Governor Bill Richardson (D), who was instrumental in the effort by granting the bill a "message" to make it germane to the normally fiscal-only session.

OKLAHOMA: Hunting Included in Management Plan for Tishomingo National Wildlife Refuge The U.S. Fish and Wildlife Service released a draft plan with several options for managing the Tishomingo Wildlife Refuge for the next 15 years. Tishomingo is located in south central Oklahoma and consists of more than 16,000 acres. It was established over 70 years ago to preserve nesting grounds for migratory waterfowl. The draft plan describes three management alternatives, all of which include some level of hunting. Comments on the draft are due Tuesday, March 23 and can be emailed to joseph_lujan@fws.gov. Include "Tishomingo NWR Draft CCP and EA" in the subject line. Comments can also be faxed to Mr. Lujan at 505-248-6874. PENNSYLVANIA: Help Stand Up for Pennsylvania's Hunting Heritage! On Wednesday, anti-hunting, animal "rights" forces met in Harrisburg to rally against organized bird shoots in the Keystone State. Bird shooting is an historic and legitimate activity steeped in tradition with many participants throughout the Commonwealth and around the world. For more than one hundred years, shoots have been held in Pennsylvania by law-abiding, ethical shooting enthusiasts, hunters, and sportsmen who would not tolerate an activity that would constitute cruelty to animals. National animal "rights" extremist groups, led by the Humane Society of the United States (HSUS), have organized and funded efforts in Pennsylvania and around the country to ban this longstanding traditional shooting sport. Make no mistake; this isn't just about banning bird shooting, but banning all hunting species by species. Now, more than ever, it is imperative that you contact your State Legislators and respectfully urge them to protect Pennsylvania's rich hunting traditions by opposing any attempts by these radical and deceptive groups to outlaw hunting. The Borough of Swarthmore to Consider "Lost or Stolen" Ordinance! Mayor Richard Lowe, a member of New York City Mayor Michael Bloomberg's anti-gun coalition, "Mayors Against Illegal Guns", has introduced an ordinance that would require gun-owners to report lost or stolen firearms within 72-hours or face a fine up to $1,000 and/or up to 90 days in jail. This proposal not only violates Pennsylvania's state preemption laws, but also potentially turns law-abiding gun owners -- who have already been victimized by theft -- into criminals. This proposed ordinance will be heard on Monday, March 1 at 7:30 p.m. at the Swarthmore Borough Hall. A potential vote could take place on Monday, March 8. Please make plans to attend this hearing and show your support for the Second Amendment. Also, please contact the Mayor and the members of the Borough Council TODAY and respectfully voice your opposition to this unwarranted, unjust and illegal proposal. Stroudsburg Area School District to Consider Ending High School Rifle Program! As we reported earlier this month, the Stroudsburg High School rifle team is in jeopardy of falling victim to budget cuts. The Stroudsburg Area School District is currently weighing the possibility of cutting off funding for the rifle team. Rifle teams, such as these, promote shooting sports, firearms training, and help foster the future of our Second Amendment freedoms. It is unfortunate that the Stroudsburg Area School District may choose to balance its budget on the backs of tomorrow's shooters. It is imperative that you attend the school board's next meeting and voice your support for the school's rifle team. The next meeting will be on Thursday, March 4 at 5:00 p.m. in the Stroudsburg High School Cafeteria located at 1100 West Main Street. North Sewickley Township to Consider Gun Ban! The North Sewickley Township Supervisors will soon consider a proposal that would outlaw the possession of firearms in municipal buildings and on township property. This ill-conceived ban, which even includes Right-to-Carry permit holders, creates victim zones by disarming law-abiding gun owners. Moreover, this policy is a clear and direct violation of Pennsylvania's preemption statutes which dictate that only the State Legislature can enact laws pertaining to firearms. Please attend the next Township Supervisors meeting on Thursday, March 11 at 6:30 p.m. to voice your opposition to this illegal and unjustified attack on our rights. The meeting will be held at the Township Municipal Building located at 893 Mercer Road in Beaver Falls. SOUTH CAROLINA: Several Firearm-Related Bills Awaiting Action in South Carolina The South Carolina General Assembly session is in full swing, and there are a number of firearm-related bills that NRA is closely monitoring. While the focus, at this time, is on budget issues in the Palmetto State, there will likely be opportunities to advance our gun rights this year. TENNESSEE: Pro-Gun Bill Heads to Governor's Desk! On Wednesday, February 17, the Tennessee Senate unanimously passed House Bill 2376. The bill now heads to the desk of Governor Phil Bredesen (D) for his consideration. Sponsored by State Representative David Shepard (D-69) and State Senator Doug Jackson (D-25), HB2376 would prohibit the destruction of confiscated firearms and require them to be auctioned off or sold to a federally licensed firearms dealer. VERMONT: Update on Bill That Could Outlaw All Ammunition As we have reported, the House Fish, Wildlife & Water Resources Committee is currently considering H. 484, legislation that could potentially ban the sale and use of virtually all ammunition in Vermont. Due to an outpouring of opposition, new language is being circulated that could eliminate the concerns of gun owners and sportsmen. NRA-ILA is currently evaluating the language and will let you know if the new version of the bill will affect gun owners. VIRGINIA: Two NRA-Supported Bills Reassigned to New Committee The sponsor of two NRA-supported bills has informed us that House Bill 108 and House Bill 109 were reassigned from the Senate Local Government Committee to the Senate Courts of Justice Committee earlier this week. Virginia Department of Forestry Accepting Public Comment on Concealed Carry in State Forests! The Virginia Department of Forestry is currently accepting public comment on the proposed amendment to Virginia State Forest Regulation 4VAC10-30-170, which would allow concealed carry permit holders who possess a valid permit to carry a concealed handgun for self-defense within Virginia's state forests. Public comments will be accepted by the Virginia Department of Forestry until Friday, April 16. Please click here to submit comments respectfully urging the Virginia Department of Forestry to amend their Administrative Code and to support the Second Amendment rights of law-abiding Virginians. Also, please attend a public hearing scheduled for Thursday, March 4 at 1:00 p.m. to show your support for this proposed amendment. WISCONSIN: Help Guarantee Your Right to Self-Defense in the Badger State! Since the Fall of 2009, Assembly Bill 193 has been idle in the Assembly Rules Committee waiting to be scheduled for floor time. Under this bill, if a person used defensive force that was intended or likely to cause death or great bodily harm, the court must presume that the person reasonably believed that the force was necessary. With limited time for this important self-defense bill to remain alive during this session, it is important that the Assembly Leadership schedule this bill for time on the floor as soon as possible. AB 193 would help restore the basic right of self-defense to which all Americans are entitled. Earlier this month, the Assembly Committee on Corrections and the Courts passed Assembly Bill 558 and Assembly Bill 559 -- two bills that, if passed by the full Assembly, would have severe effects on gun owners in the state of Wisconsin. WYOMING: Constitutional Carry Passes Out of Committee! Last week, the House Judiciary Committee passed House Bill 113. This bill would allow those who meet the requirements currently set forth in the concealed carry permit system to carry a concealed firearm for self-defense without a permit. If signed into law, this legislation would also keep the current permit system intact for residents concerned about carrying in other states with reciprocal agreements. Those who are currently prevented from legally carrying, be it open or concealed, will still face the same penalties should they decide to break the law.
