Its time for scotus to put an end to this. This is the United States. Not Great Britton, Canada, Australia, or some other faction of Queen Elizabeth's monarchy. Its not France, Germany, or Italy or another signatory to the E.U.

We are a sovereign nation whose government is supposed to be reined in by the constitution. A document that recognizes an individuals right to be armed that is not to be infringed.

The article leaves out a huge detail, why was the gun "illegally" owned? Was he a felon, or did he just not satisfy the draconian requirements to own a gun in NY?

If he is a felon, so deranged and dangerous he can not be allowed to protect his life and property, why is he not still in prison?

I have already read it was reported as a "home invasion", but the police had dismissed it as a "home invasion". I'll wait for the whole story...

It surely seems the legs of justice are no longer equal. Not knowing the full story leaves some room for speculation. Wouldn't it be twist if the guy wrestled them and shot them with their own gun?

Danny not to derail this thread but can't help notice your thing at the bottom "Its time to end political parties ". Perhaps in another thread or something you could address that, and just how that would work. If its already been addressed then my apology, I've been busy in between rains and may have missed it.

According to the article and who knows just how accurate it is, the homeowner has only been charged with the crime of being armed. Being armed without permission in NY most certainly is a felony. Many other states as well. NY requires a license for a legal possession of a handgun even in the home.

That seems to be the deal Danny...The home owner does not have a NYS Pistol Permit for the hand gun he used in his home...

So why does the Supreme Court appear to sanction this clear violation of the right to be armed? States have a lot of room to write state law but only within the framework of the U.S. constitution. Shall not be infringed.

Sounds like the robber had more/as much right to use a gun in a robbery than the victim.

You know the second makes no distinction or prohibition on felons bearing arms. It was state laws that started that under the "black codes" that disarmed free blacks. It wasnt part of federal code until 1968.

Used to be you paid your dept then returned as a full citizen. If you couldn't you hung.
The day is coming when all of us will run afoul of some technicality with the ever growing regulation, then what?

He could have gotten out of the whole mess, if he had just said that he wrestled the gun away from one of them after they broke into his place to rob him. In the fight for, and in fear for his life, he shot them both. Just had to say it was their gun. That is, if the gun was not registered to him , in the first place.

Yup, never talk to the police until after you talk to a good lawyer. Same thing for a traffic stop, give your required documents and exercise your right to privacy for all the 'usual' intrusive questions that do not have anything to do with the reason they stopped you.

Looks like the shooter used a gun that he inherited when his father died, he never registered it.

Right now, Stolarczyk is charged with felony gun possession because investigators believe he used his deceased father's gun, which he never registered to himself, to kill the two suspected intruders

Just another case of a unconstitutional law making a criminal out of an otherwise law-abiding citizen. I'm surprised to hear NY has a castle doctrine with the other dumb firearm laws they have.
