At first blush it looks like a Biden win with the house under democrat control. However, read the fine print.
Per the Constitution each STATE DELEGATION GETS A SINGLE VOTE.
Republicans hold the honor of holding the majority when counted by delegation.

He may have even less after January. The Senate races this year don't support much hope for many flips. Two that do come to mind are offsetting
Jones in Alabama and Snowe in Maine. At best he holds the status quo at worst he loses a couple. I hope I'm wrong and he gains seats but I doubt it.

JMO, but it's an opportunity to put shaky candidates like Snowe on the carpet by forcing them to take a pro Trump stance.

Of course we all know the traitor from Utah will attack the president no matter what.

It's also why it's guarateed the choice won't be Cruz or any other Senator as he can't afford to lose a single vote.

I'll be honest I'd like to see her replaced with someone from the Trump administration just as much as anyone. However, when Obama nominated Garland going into the 2016 election everyone was astounded that Obama would even consider calling a new justice just prior to the election. Doesn't seem fair that Trump rams one down the pipeline now.

Yeah now is not the time for fair play. The other side has shown nothing but disregard for any precedent or "fairness".

But ramming one through could be the nail in the coffin if Biden wins to see the left adding however many justices to the SC as they think they need to secure the majority for decades.

i dont think it would be so easy to use the same tactics on a woman, that they tried to use on Kavanaugh. it was all sexually based lies. seems it would be more difficult with a woman. they would have no MORAL ISSUES with trying to destroy a woman, i just feel it would be more difficult, and theyd fail.

Actually, I think if no decision then you're right the ruling under question (which I assume would be a state Supreme ruling) stands.
The House option only applies if no majority is reached in the electoral college.

I think the best course of action is for Trump to quickly nominate Amy Barrett. This will cause the left to riot in the streets and completely melt down. I think this will cause even more people to reject the left. After the election, win or lose, move forward with the confirmation in the senate.

It would be nice if a judge that was nominated had an actual record on some of the major issues that SCOTUS has been quiet or flat wrong on. Look back a lot of the recent judges by Trump and Bush and see how scant the records of those judges has been and see how thats turned out for us.

FYI, the next oldest at 82 is Breyer, another lib. Thomas 78 then Alito at 72. Kagan and Sotamayer and Roberts are in their 60s, Gorsuch and Kavanaugh 50s.

If the three oldest die or retire in the the four years the possibility exists for Trump to name six justices all in their 50s for a 7-2 conservative court for at least a couple decades.
I imagine the impact of such a court will be felt well into the next century. This may well be the single most important election of our lifetimes, vote accordingly.

I thought Gorsuch fit the bill but not sure. We need another Thomas or Scalia. Read the Constitution and apply it to the law. The swamp has a way of changing most. Vote the wrong way and get ostracized by the media day after day, not invited to the fancy DC parties and holiday get togethers with the in crowd. It takes its toll on most. Nobody wants to be “That guy or gal” Takes a special person to stand up to the pressure.

Just watched a news program and there have been 29 times that there was a vacancy on the court during an election year 8 times with the president and Senate from different parties nominee failed to be confirmed 1 times they did in 1888. Then you have today's situation where both the president and Senate are from the same party that happened 10 times and only 1 was not confirmed. The other times every president did nominate someone but they did say the outcome it may have carried over to the next term.

Trump will nominate someone and chances are they will be confirmed. Jmo

Three years ago, McConnell led the successful effort to obstruct Obama's choice of Merrick Garland, chief judge of the U.S. Court of Appeals for the District of Columbia Circuit, to fill the vacancy created by the death of Justice Antonin Scalia.

McConnell's reasoning at the time? It was important for the Senate to "give the people a voice in the filling of this vacancy" by waiting until the new president took office.

You really do have to admit, our country's founders were darn insightful. Men fight? Prideful people bicker? Monarchy on earth a threat to liberty?
We better set it up so 3 branches fight, instead of that darn king in Great Britain giving us orders all the time, and only a fiddle-faddley parliament fighting over his rule, and doing nothing all the day long!

I wonder who the first one was to offer in the room; "Hey, let's set up 3 equal branches, executive, judicial, and legislative, and let 'em ALL fight it out. At least it'll consume the oxygen in the room as they do, and things will not be the same as this bloody English monarchy thing.

Democrats in the last 3 1/2 years have spent like fifty sixty million tax dollars, mine and yours trying to undo Trump's election with multiple bogus investigations. That might be water under the bridge with some folks, but it for sure ain't with me.

This is a war, the regular folks like most of us, against the elite who can't allow themselves to be stripped of power. That's why they hate Trump so much, it's what he represents, a future where career politicians aren't necessary.

Trump is going to have a hard battle.

There are 53 republicans in the Senate and he needs 51 votes. Four RHINOs have already come out with statements that they won't vote for a nominee until the next president is seated: Lisa Murkowski (AL), Susan Collins (ME), Chuck Grassley (IA), Lindsey Graham (SC).

And the worst one, Mitt Romney (Pier Delecto) hasn't come out with a statement but you can be sure he will do everything he can do harm the president. He'd vote for RGB again just to stick it to Trump.

Thats how I see it too. I think Lindsey could be convinced to cast a yes vote with some arm twisting, but no way the others you mentioned are going to entertain the thought. Especially Mitt.

I wonder if Historians will look back on the last 2 or 3 Supreme Court decisions prior to Ginsburg's Death, and question if she was of sound mind; when she made her decisions . With her having had Pancreatic Cancer, she had to have been loaded up on some serious pain meds. Could a case be reversed if a Supreme Court Judge was later found to not be of a competent sound mind, because of severe illness ; that ended up resulting in the Judge's passing ?

Maybe James will try to change your mind. He recently refereed to President Trump as "swine" on a thread about the President receiving a Nobel Peace Prize nomination. He also infamously wrote the he would "vote for any Democrat with a pulse" before voting for President Trump.

This may not end well, these people do not get what they want and they will burn down dc. They have been allowed to riot and burn all year which has only emboldened them, at some point severe actions will need to be taken to get control of things and then the republic of laws can function. I just do not see how any of this ends without lots of violence. The time will come when either you just let them take over and form a government of who they want that functions however they like it to or you need to swat em down like flies.
