What is the best course of action for a bad check.

I had a guy buy half a beef from me. I delivered it to the processor and the guy left a check with the processor for me. I cashed the check.to find that the guy had stopped payment on it. He says it's because he didn't receive all the product. He wanted some very unusual things and apparently did not relay exactly how he wanted some parts to the processor effectively. The processor has bent over backwards to get the guy what he wants.

He is supposed to go to the processor tomorrow to pick up the remainder of his corrected order, and bring cash for me. BUT he is saying if the order is not exactly how he wants it that I will not get paid. I am not the processor I just sold the animal.

Does anyone here have experience in a similar situation? Any advice if he decides not to pay?

We sell the Beef- quarters or Halves to the Buyer. Cash in hand before the Butcher picks up the animals.
After the sale the Beef buyer and customer are now the only ones still doing business.

We do not take personal checks.
Cash, postal MOrder
Or FB pay. All instant and No fees

I have sold a boat load of beef the same way as you and have never had a problem with a bad check. You however are dealing with a scam artist. I would call or pay a visit to the local District Attorney. If he kept one ounce of the meat, his check had better be good , If he has a problem, It all has to be returned or I would treat it as stolen property. When he picked up the meat, left payment and left the locker plant, He accepted the order, period.

Stop payment and bad check are not the same, that being said sounds like he's trying to beat you down on price. Either he pays in full or you make a concession in price or if it was me I would tell him I'm coming to pick up my meat and I would reimburse the locker.

Yes he has all the meat. Get this... The screwed up part of the order is that he wants the head with the skin on but hair removed. He also wants the hide with the hair removed. TO EAT. He has all the truly edible parts already. This is the first time I have ever had a problem selling like this.

The guy is a doctor and is now claiming that his wife is a lawyer. Thinks it should get them preferential treatment.

All you mentioned has nothing to do with you, sounds like that's on the locker. This guy sounds like a nut or a foreigner or both. Being his wife is a lawyer she should know you fulfilled your end of the deal and should be payed what's owed. Small claims court is another option, lot's of paperwork but you would probably win at least in Mn.

Yes he says that he is from Nigerian decent and that his wife is from Nigeria.

He accepted the order,,and left payment.He wanted the head and skin? Did he think the head and skin were wrapped into one pound baggies?He is jerking you around,,and I wouldn't talk with him anymore.Start small claims court proceedings immediately.DO NOT accept the meat back.Who knows how he has taken care of the meat once he got it.

If everybody gets a head with their half. I'm thinking a 2 headed calf would be worth more to a circus.

he should have filled out a cutting and packaging list with the processor. If he did then the head and hide request would have been on it and unless your processors crazy he would never have agreed to de hair a head and hide.You only sold him a 1/2 of beef so how does he figure he gets the head and the hide at best a half of each lol.Did a mobile processor kill the beef ? If one did thats where the hide is. He's just trying to scam you so you'll lower the price .I'd file in small claims court and get him served asap.

Technically that constitutes theft. I would have him arrested. See how his Nigerian lawyer wife handles that.

Couple buddies of mine and I were processing deer back in the day.Had this one guys deer(a doe) all processed wrapped up ready to go.He comes in ,,pays me and takes his meat.Couple hours later he comes back in.Says that's not quite what I expected.I sais we cut just like you wanted it.He says but I expected a LOT more steaks.LOL,,I said then you should have shot a bigger deer.Well,,one of the guys processing with me knew this guy,,and ended up giving him a few packages of steaks off ONE OF HIS OWN DEER,,just to make him feel better.I Told my buddy,,your and idiot for doing that.Why didn't you ask him if he expected an 8 point rack to go with the extra steaks off his DOE.I love how folks will bring in a 90 lb. deer and expect 100 lbs of steaks off it.

your going to be out the money. even if you hire a lawyer and get a judgement. go upside his head and he will get a judgement against you. live and learn. cash is king

Unless your gonna spend a lot of money there's not a lot you can do. But do request your beef back or payment. Even if you can't get full price something better than nothing. Don't do business with him again. Also check into some federal laws on what he is asking for. I'm not sure a butcher shop can legally sell some of that for human consumption. I had a lady ask for the intestines and stomach. Butcher shop couldn't legally do it. Solved the problem real fast for me. Lol

In the future, if you're going to accept checks, have them given directly to you and make sure the funds appear in your account before delivering any goods or services.

Not possible when running a business. If I demanded cash only for goods and services customers would soon be in short supply.

Small deals through Craigslist or Marketplace are always cash but very few would fork over $10,000.00-$15,000.00 in cash for the 30% advance payment I require on all building and remodeling jobs.

I would say he probably scammed you from the beginning. You'll have to take him to small claims court is my guess.

On building and remodling jobs you have recourse in the form of a lien. sell somebody half a beef and they dont pay your just lost half a beef

even after you get a judgement if they dont pay nothing is done. you can garnish wages if there are any. if someone didnt garnish them first

A Doctor and a Lawyer? Is their son a Nigerian Prince? That's a load of crap to intimidate you, don't buy it. Being Nigerian, maybe they have some kind of ritual thing they do with the head, but, who cares. Sue their tails off. In Mo, it's against the law to stop payment on a check without an exceptionally good reason.

Going that route would be a huge PITA and tie up money indefinitely. Simply waiting for a check to clear your account solves all kinds of problems.

Did the processor get paid? If so then part of the unfinished order may have been on them. I agree with Bernie go to small claims court. You may not win but if he is a doctor and she is a lawyer they may not want their names in the paper or court record for a few dollars.

Check with an attorney, you might need to go ahead and deposit that check so it bounces and you can show fraud on his part.

Contact your States attorney and see what his thoughts are about this because different States view checks differently so it’s a crap shoot. Explain it clearly to him if he put in the cut order how could it be your fault?

If he’s not paying you I’d think that that beef is yours to pick up, you would think taking ownership without paying would be theft in my book but SAs are often lazy. Sounds like this guy lives by the I take and find a reason to not pay for everything I can get away with. See what your local Sheriff says he’s the top LEO in your County he might step up.

I’d pick it up pay for the processing if needed and sell the “bad” cut beef to others willing to pay a fair price for it in cash!

That's the thing, I did cash the check. Then when I was online checking my account a few days later I noticed a charge back on my account. By the amount of it I knew which check it was so I called him. He said he didn't know why there would be a problem with the check but he would talk to his bank and find out what the problem was. Then yesterday I got the letter from the bank about it that showed that he had put a stop payment on it. So I called him again angry that he lied about it. Had to get off the phone with him before I said something too stupid.

He is claiming he will bring cash tomorrow for me but supposedly I only get it if he is happy with how the processor finished his order.

The processor did get paid and he cashed his check a couple days before I did mine. He says his appears to be ok. the customer already has the meat. This is all over the preparation of the head and hide for consumption. He was not clear on what he wanted and it's not a service that the processor usually provides. He was just trying to make a difficult customer happy.

People make a living complaining about everything and anything to get it cheaper or for free you will find a lot of guys that never deal with the same guy twice because they turn everything into a game. If he gets all the meat for free and does not pay a dime go to civil court and ask for judgements until your paid this guy is depending on you folding so don’t. States Attorney, Sheriff then Vito but get paid!

I would find out if he is the kind of doctor that can set bones and apply stitches if he did not pay me or return every ounce of beef he took possesion of.

Take him to small claims court. It doesn't cost much to file in ks once they serve papers on somebody they usually pay up. We never used a lawyer in my business just filled out the paperwork ourdelves.

I have gotten my money. He would not give it to me until he had checked all the remaining product to make sure it was how he wanted it. Honestly it was a mess but that is apparently how he wanted it.

He did finally pay in cash then wanted to give me a fist bump. I just looked at him and said don't even bother. I let him know what I thought of him.

If it was me and the deal went bad he would be picking roadkill out of his yard every day. The nerve holding you responsible for how it was processed....I would still toss afew his way.

I had a Nigerian pull crap on me one time. He sold a bunch of furniture to a college student and asked me if I would deliver it. I said I will be in the area Saturday and will pick it up around noon. I arrive at noon with the dump truck, and he tells me to come back later! I said now or never. He said I was disturbing his lunch! Finally loaded the furniture and I said pay me and he said no,no you collect from her for delivery. I said pay me or the stuff gets dumped in your driveway, she pay you ,she pay you! If you saw the look on his face when the dump body started going up, he nearly pooed his bathrobe!
Long story short, he paid and I asked the girl if she was suppose to pay me. She said delivery was included in his price.
