If Pelosi started with two hammers I'd say the other guy was defending himself.

The police witnessed DePape take the hammer from Pelosi and hit him with it. The police knew who Pelosi was. If the police thought DePape was going to do serious harm to Pelosi, they should have shot DePape. The fact they didn't shoot him likely says a lot about the seriousness of the attack.
