Most lawyers say yes, but they need book-length commentaries to justify this position.

Grundgesetz Art. 146 says:
"This Basic Law, which shall apply to the entire German people after the completion of the unity and freedom of Germany, shall cease to be valid on the day on which a constitution adopted by the German people in a free decision comes into force."

Many say "adopted by the German people in a free decision" means in a referendum.
It would be easy to end this discussion by holding a referendum.
But politicians are preventing this by all means. They seem to be afraid this would open fundamental door for further referendums.


Regardless of this fundamental discussion, the Germans and their politicians are no different from the Americans. They refer to the Basic Law when it benefits them and ignore it when it's convenient.
