I don't think anyone is saying he should be thrown in jail without a trial. We all know that IF (and that's a big if) he is charged with anything, he will get a trial. I think what most people are saying is that he won't even be charged with anything due to his celebrity status. Charge him with negligent homicide like anyone else would be charged, and let the court sort it out.

Ever see a movie where the gun bore is facing you the audience? They get that view by having a camera directly in front of the gun with a camera operator behind the camera and in this case the director was standing directly behind the camera operator, likely to get the camera's viewpoint.
Pass through is very possible.
Blame is on the company weapons handling routine, at least two other people handled the weapon before the actor touched it, the armorer and the assistant director. Actors live in movies where everything is fake and everything is expected to be fake. It's probably not realistic to expect them to treat a known fake gun with fake bullets as a real life situation.

TJM why can't they film from a safe distance? Why can't they use remote controlled cameras? Why can't have a stationary camera rolling without an operator? There's more than enough options and tech where people don't have to be in the line of fire.
I don't buy the fact a blank went through a chest and into another . Even if there was shrapnel the gun would've had to been pressed to the chest.

Regardless of what charges result; Baldwin will have to live with the consequences of his actions for the rest of his life, if he has any conscience.
