Likely was the insurance company that elected to settle. They're the ones who paid and have the right to determination in the settlement. And it does set a poor example of "Stare Decisis", a juridical command to the courts to respect decisions already made in a specific area of the law., in this case, an illegal use by a criminal of a legal product. Yep, opens up a can of worms and we have become a more litigious society.
