That is not a negligent discharge, it is an accidental discharge. A negligent discharge is the result of the firearm functioning as it should but the person holding the firearm pulling the trigger inappropriately. An accidental discharge is when the gun is not functioning properly and discharges through no fault of the person responsible for the gun. However the correct action for him to have taken was to firmly hold the rifle, push the magazine release button and then while keeping control of the rifles muzzle and keeping it pointed down range clear the round in the chamber.
