I was unaware of. In Pa and who knows where else you have only same day priviledge to return it Not 24 hrs, within the same day. Clerk gives me Copenhagen wintergreen instead of regular-she throws it in the bag. Well, I didn't need it until the next morning and see its wintergreen. OK, another 10 mile round trip to get it right. Me- clerk gave me wrong snuff Her- we cant do a return for it Me- why not, its not open, clerk gave me the wrong item She looks dumbfounded for awhile and gets another woman. Her-yea we cant return it. Me-why your clerk made the mistake, whos paying for my gas to rectify your mistake? Her-its a federal law Me- why? Your kidding, your not going to make this right with me? wanting to know why such a short time to return it. Her-ask them ME-OK then, wheres the clerk, I will get the money from her Her- why didn't you look at it before you left? Me-She threw it in the bag and I figured she knew how to do her job. Long story short the first woman knew nothing, the second woman wanted only to fight with me, a guy above her came over and all ended well. There were issues about my phone card they couldn't figure out either. How am I suppose to know this law until it happens to you? Make sure your stuff is right before leaving the store.

Earlier this year here in WV I went into my usual store early one morning before work and asked for a 5 can roll of Copenhagen long cut. The cashier grabbed a 5 can roll scanned it bagged it. It did not look like it was the correct plastic on the roll. I questioned it and she replied new design. I though ok this store moves a bunch of tobacco so she would know. I pay grab the bag walk directly to my truck parked in front of the door. Before I got in I grabbed the roll out of the bag to put a can in my pocket and noticed she was wrong it was Copenhagen Regular. I turned around and went back in the store 2 minutes tops had elapsed since I had checked out. The same cashier would not exchange the rolls as she said it was against store policy. I let her know it was her mistake and my mistake for not double checking when I questioned her the first time. She told me I could come back later and speak with a manager. I stopped back after work and explained what happened to a manager but she told me the cashier should have exchanged it in that short period but that she could not exchange it now because 9 hours had elapsed and it would be against policy. I was lucky and able to sell it to a coworker the next day, but I have never stepped foot back in that store.

Here in Michigan, there are no exchanges on alcohol as soon as you step out the door.
When life gets me down..... you know hunting/trapping season is closed.

Got a roll of wintergreen longcut, wanted regular longcut. Took it back the next day, outer plastic wrapper still intact, there was a dif clerk so I explained what had happened. She exchanged it for me no problem. I never thought of A LAW concerning unopened products being returned for exchange.

Never assume a clerk who can't even count change can read. I would say that one is on you. You know what they say when you ASSuME. You need to check items like that yourself. Maybe you are trying to blame someone else for a moment of cranal/anal dissorder. Don't forget your hat ...

Next time the snuff/cigg folks stop by I'll ask if that's federal law. If it is, it's new to me. Might be a state law? Most likely just store policy.
Above you said that it doesn't make any sense, I'll tell you why it would be store policy, you can't trust folks. Copenhagen comes in cardboard boxes, it'll dry out fast. If someone returns a box that has been under the truck seat for 6 months, the man that buys that box will be PO'd.
Another thing about tobacco, state taxes are so different. A lady told me the other day she could buy a carton of cigarettes in Virginia, the exact same brand, for $20 less per carton. A trucker friend of mine said that a $6 pouch of Levi is $12 in Texas. That's just state taxes.
Everyone makes mistakes. It's just like here behind me, I've got regular Copenhagen, long cut, wintergreen, straight, natural and Southern blend. It's very easy to grab the wrong one.
But the way I understand what happened, that should have been taken care of at the register, no questions asked. The clerk should check the date, make sure the seal is still good, square up with you and send you on your way.
Regular Copenhagen sells for $4.30 per can here, plus tax.
