I didn't say anything about how additional justices should be picked. Maybe a panel made equally of Ds and Rs could recommend some names to the president, who could then nominate them to the Senate.
Yeah, like that's going to happen. The Left still have a lot of anger and resentment over McConnell's own little court-packing scheme, sitting on Obama's nomination for more than a year, leaving the country with a less than fully staffed Supreme Court the whole time. It worked, but it was it ethical? The Dems don't think so, and are furious about it.

Ed, I think you're wrong. The Ninth Circuit Court has had to increase the number of justices at least twice that I recall to meet increased workloads.
It defies logic to say the same size court can handle ten times the amount of cases.
Or maybe you think we should reduce the Court's size to three justices?
Jim In the circuit courts, 3 judge panels hear cases. Adding 3 judges means opening another courtroom to hear cases. 9 judges can hear 3 cases at a time, 12 judges can hear 4 cases at a time. At SCOTUS, all the judges sit on every case. Adding judges to SCOTUS won't let more cases be heard.

Like MG said, the circuit courts operate differently. Although I agree with James' point on how some of the work is distributed, all the justices hear all the arguments made before the court. In the circuit courts a 3 judge panel hears it first and makes a ruling. Sometimes that ruling is challenged and brought before a 10 judge panel (9th circuit).
James point about workload distribution is valid, however, there remains the bottleneck of every SC justice hearing every argument, questioning, discussing, and debating. Adding additional justices would not fix this aspect. The circuit courts following the US Constitution would help significantly in reducing the SC workload IMO.

The Court has been the same size, nine justices, since 1869. In the 150-some years since, don't you think the Court's caseload has increased? By more than a factor of ten probably.
Increasing the number of Justices would allow the Court to review more cases.

Of course the justices all attend the hearing of the case. But who do you think writes the opinions? They don't all write opinions on every case. Writing an opinion is most of the work involved in a case. Attending a hearing involves sitting on your arse and maybe asking a few questions.
Increasing the number of justices would increase their workload capacity. Otherwise, why not have just three of them?

The bulk of their work consists of legal research and brief-writing. Much of that work is done by their law clerks, but the justices are involved and have the final word. They can only work on so many appeals per year.
I've handled appeals for either the appellant or appellee in Alaska Superior Courts in Anchorage, Fairbanks, Sitka, and Kotzebue; the US District Court, District of Alaska; and the US Ninth Circuit Court of Appeals. I've seen the sausage being made.
Has anyone here ever been involved in an appeal?
