The Canadian Border is secure ??? LMAO !!!!!!!!!!!!! Go to the Adirondacks in Northern New York. There is NOTHING to stop someone from crossing into Canada through the Woods or walking across a Creek. It's all WIDE OPEN !

We shouldn't have to rely on private landowners to enforce immigration laws.

Putting up an electric fence that might cause death or injury to humans might just get you sued. Yes, even an illegal might sue you, in our courts too.

James:

Let me get this straight...

A Mexican or whoever, from where ever, crosses into the United States of America illegally . (That's one illegal act) Trespasses onto Private Property. ( 2nd Illegal act ) and for good measure, lets say they also destroy some of the Ranchers property , and or litter on that property. Are you saying that the Rancher has to depend on Law Enforcement to go after those people after the fact?? If they are illegal Aliens and have broken all those laws, why do they have the right to sue the Rancher ? Seems like the Criminals have more rights than the innocent Property Owner.

I don't know the law in Texas or those other border states. In my state, even a trespasser can sue a landowner if the trespasser is injured by something unreasonably dangerous on the property.

Now whether a jury would rule in the illegal immigrants favor is a different issue. If I were the landowner, I'd request a jury trial. The judge would tell the jury they must follow the law, but that doesn't always happen. Ever hear of jury nullification?

Even burglars have successfully sued property owners.

How could a Jury find in favor of the Burglar ???

Trapped Burglar Sues Homeowner
A fine example of good sense failing is the case of Terence Dickson. In the process of exiting a house he had just entered and burglarized, he found that his planned escape route through the garage was a dead end as the door opener would not function and he was unable to open the garage door. Turning back to re-enter the house, he found that the connecting door had locked behind him! He was forced to spend the next eight days with only a case of Pepsi and a bag of dry dog food.

Mr. Dickson, upon regaining his freedom from the garage, filed a suit against the homeowner’s insurance company on the basis of his having suffered mental anguish during his unintended confinement. Incredibly, the jury determined that Mr. Dickson was to be paid $500,000 for his suffering.

The US Canada border is very porous. On either side of the Al-Can Highway, there's nothing but woods and tundra.

Years ago I knew a guy who smuggled a backpack full of pot from Canada to the US, just by walking parallel to the highway, far enough from the checkpoints not to be seen. He had a buddy drop him off about a mile from the Canadian border, then pick him up again on the US side.

The same tactic would easily work in reverse. So my modest proposal is to fly planeloads of illegals up here to AK, and we'll feed and house them (with federal dollars) and transport them to within a couple miles from Canada, give them maps and supplies, and turn them loose.

The judge probably instructed the jury to disregard the poor victim's status as a burglar.

It's interesting that you say that.

It reminds me of something that happened many years ago in Rockford, IL, I think it was.

I wasn't the agent on this, but this couple had a renter's policy. They lived in an apartment building. The husband was a trucker; on the road for days at a time occasionally. He felt uncomfortable about his wife being alone while he was on the road since there had some recent break ins in the area. So, for protection he got her one of those pearl-handled, silver Browning, 25 caliber, semi-automatic handguns.

One night while he was on the road, a noise woke her. She realized someone had broken into her apartment. The burglar noticed she was alerted to his presence. He quickly jumped on top of her while she was in bed. She managed to get her Browning in her nightstand drawer. She fired several times at the intruder. Only one shot actually hit him. It immediately disabled him as it hit him dead center in the knee cap. The police came, arrested the man.

But, that wasn't the end of it. Several months later, the burglar filed a lawsuit against the lady who had accosted stating as a result of her actions, he had become permanently disabled. It was never brought to trial and the suit was dismissed. But, since there are liability coverages in a renter's policy a claim had been set up.
