Logistics. This is common when you have high profile cases such as this. They are most likely rushing the firearms, shell casings, and DNA swabs to the FBI crime lab for irrefutable direct evidence before filing the capital murder charges.
Capital Murder charges create a tremendous legal burden on the state and especially the county in which the offenses occurred. Then the draw out appeal mess is horrifically expensive for the county and the state. Once they get the evidence linked directly to him, it does help with the future appeals process once convicted and provided they actually seek the death penalty, they may not seek the death penalty since that is now an option, however, the defendant must make a guilty plea. In doing so, he voluntarily and statutorily waives any future appeals on the case(s). There is no parole for a guilty plea on Capital murder convictions. You die in prison. Which, it is far cheaper to not seek the death penalty in the long run than to fight the asinine arduous and expensive appeals.

No, only those of us in Texas will be paying, unless they move forward with the Federal cases. Should they go ahead and file the Capital murder charges, the Feds will not proceed with anything other than the firearms, ammo and reentry. Then they will only indict one firearm count, one ammunition count and the reentry. The way the Federal courts proceed with criminal cases, and the level that the Federal Judges hold both the US Attorneys and the Defense attorneys, he will plea on those and it will be a very short process. Been there way to many times on these cases. And, as the case Agent in Federal Cases, you are sitting at the table with the US Attorneys. Unlike in State court, unless an agreement is agreed upon by the State and the Defense and approved by the State District Judge.

Too bad he be won't be extradited back to Mexico to serve his sentence. Their jails are much worse our jails. But being caught in Texas he stands to be executed doesn't he? Sure deserves it. Ron White says the have an Express Lane ..in the Texas prison system ..

He was an illegal immigrant that was deported a number of times. Execution is one way to make sure he doesn't come back again.

Then they lock him up for the rest of his life and the tax payers pay for and care for him till he dies from old age, REALLY! why? Even on death row, it takes years before they give him the needle. In an open and shut case like this execution shouldn't take more than a year at most.
