The vehicle entering traffic or passing has the "greater responsibility" to do so safely, the insurance company will blame them every time.

I went to pass a vehicle when I was in college that had its right turn signal on, as I was passing him he turned left into me. He was drunk. Ever since then I assume every turn signal is controlled by a drunk or a moron. My wife gives me crap all the time about waiting on people to commit to the turn before crossing their path, I just say you do it your way I will do it mine. LOL
