And I had a nice long reply all typed out, lol.
so from a view point from outside the united states it looks like the "ICE" units are violating at least 3 of your Constitutional Rights and that's what's upsetting the democrats and republican who are actually joining together even calls from retired/discharged vets to join in the fight and uphold the constitution that they swore an oath to protect
Unfortunately, that's a common misperception based upon an incomplete knowledge of the Consitution with misapplied cross reference to the Declaration of Independence plus a lack of knowledge of just how our immigration laws/courts operate. But I would not expect other nations to know any of this when our own citizens can't be bothered to read the instruction manual.
First, Constitutional rights and law only apply to CITIZENS. Or more appropriately THE PEOPLE as in We The People that established the Constitution.
The misapplication comes from "We find these truths to be self evident that all men are endowed" from the Declaration of Independence. The Declaration is just that, a declaration of beliefs. And while we do believe that all of humanity shares these inalienable rights they do so under there own proper jurisdictions while under the rule of Nature's God. These rights do not extend to persons outside of their proper juridiction or outside of the rule of Nature's God. Though we strive to respect these rights of others.
Now for the complicated but clearly written specifics of immigration law. As foriegn nationals have never been recognized as being among "The People" they are not entitled to the protections of the Bill of Rights and amendments. Hence they do not get an automatic right or access to "trial by jury", (they have no peers for one) as spelled out in Article III of the Constitution, which establishes and defines the judicial branch. So no requirement for warrants, trial, freedom from search, etc.
What immigrants do get as regulated by Congress is adjudication by Article II, establishes and defines the executive branch, immigration judge under the authority of the executive. This sort of court is not a criminal court but instead an administrative one. Deportations are carried out under finding of fact that said person is illegally in the country, period.
And to toss in the right of protest. No where in any of our founding documents is the right to "protest" recognized if by protest you mean to impede the operation of governance, or to bring harm to others to include disturbance of the peace. What is recognized is the right to PEACEABLY ASSEMBLE FOR REDRESS OF GRIEVANCES. Some commie agitator coined the term "civil disobediance" as a cover for riotous behavior.
