This is question to stem off the other discussion, but just looking for a clean thread about what can or can't be relocated in your state you operate in.

1) Can you relocate certain species?

2) Which species can you relocate?

3) Any restrictions? (landowner permission, no state land, non rabies vector species only, time of year?)

Strictly curious, I know many nwcos live in states where allowed or even encouraged, others live in rabies states and many species are blocked from relocation, looking for a good thread on how many states allow, please state your state for clarity if it isn't in your profile (which it should be).

1) Yes a few species

2) In NM we are open to relocate non rabies vector species including squirrel, beaver.

3) Non rabies vectors only, with beaver permission up and down stream from release site must be obtained before relocating.
Bear and others can be relocated but most is done by the state game wardens in this regard as are most beaver complaints.

All carnivores to be euthanized.
Non carnivores to be relocated with written permission of property owner, no state land.
Deer, bear, turkey, and alligators >4' not allowed.
Beaver, can not be transported alive. (No laws against relocation, though)

In N.Y. it is legal, as long as you meet the list of lengthy requirements. First, every year you have to contact your local health dept. (to see what their protocol is for relocating rabies vector species animals). Then you have to abide by the D.E.C requirements listed on your license, over 5 miles from capture site, in the same county as captured, into a suitable habitat for the type of animal being released, and written permission from the landowner. There are also stipulations where you may relocate to state land, if you get the written approval from the Senior D.E.C Wildlife Biologist in that region. I asked one time, and the reply I received wasn't capable of being repeated on this forum.

Justin, Wisconsin is one of those states that prefers euthanization, but is once again, this year, being challenged by our governor on its stance. ( This is another whitetail deer thing and I've probably seen a half a dozen ) Why our DNR would get involved in taking a perfectly healthy fawn away from a rehab center and killing it, so that all of Wisconsin can see, is some of the dumbest law enforcement from the same DNR department that should be admired!

I used to hate to admit to the fact that 25 years ago, I was instrumental in getting the striped skunk its due! I don't anymore. When I started this business, the humane society asked me if I would relocate skunks if a customer asked me to. My reply, "the customer is always right".
Humane society..."But you would be breaking the law!"
Me..."I don't think so".

This little conversation established that it was perfectly legal to relocate skunks. ( Now before you get all excited, you need to know that Wisconsin has very few rabid skunks, although 'Yours Truly' had one in a posthole next to his house )

While I may have the tendency to be awfully nice to animals like skunks, bare in mind that the person who actually runs this zoo ( That would be my wife of 45 years, usually referred to as Gramma ) has a way more intelligent view of things than I do.

Release on site is not an option in Georgia. It boils down to possession, once in possession the rules apply.

I found out after my son graduated from college that he had done some beaver work for an entity. They required the beaver be relocated per public request. He relocated every beaver by law. He told me the entity understood the methods used and understood the state's law on relocation.

He used 330's.

They told him they just wanted to tell the public they were relocated. They had him write relocated on the report. They didn,t want him to specify dead or alive or methods used.

(3) It shall be unlawful to fail to euthanize, or release on site, any nuisance raccoon, skunk, beaver, coyote, fox, or opossum that is captured, trapped or taken.

Except as otherwise provided, it shall be unlawful to fail to release all other nuisance wild animals:

(a) Outside the limits of any incorporated city or village,

(b) On public or private property without the permission of the landowner,

(c) Squirrels, chipmunks, woodchucks or moles may be released or may be euthanized.

WCR 302 (A)(3)
Tree squirrels, cottontail rabbits and raccoons can be relocated without a permit, provided that:
• The CDOW has been notified in advance.
• The relocation site is appropriate habitat for the species.
• Permission has been obtained from the landowner or managing agency where the animal will be released.
• The relocation must occur within 10 miles of the capture site.
4.) WHAT IF I WANT TO RELOCATE AN ANIMAL OTHER THAN TREE SQUIRRELS, COTTONTAIL
RABBITS OR RACCOONS? WCR 302(A)(3), WCR 303(F)
If you want to relocate any other species, you must first obtain a Relocation Permit from the CDOW.
5.) WHEN CAN I USE BODY-GRIPPING/DEATH TRAPS?
Amend.14, Statute 33-6-203, Statute 33-6-204, Statute 33-6-207, Statute 33-6-208 and WCR 302(A)(2)
In November 1996, Amendment 14 was passed by ballot initiative. "This banned use of traps such as snares, Conibears,
leghold traps, etc. for the recreational take of wildlife".
• You can use body-gripping/ death traps for mice and rats without a permit (as listed in #1).

You release them up the drainage from where they were caught and you have job security. If there are few roads to get back on the drainage you choose, the chances are they won,t get hurt.
