my dad had this happen twice , with two piece's of property , he won both times , how much land do you have behind him ? is it worth your trouble and time an money ? good luck It’s only 18 acres. No doubt I am going to have to invest, the question becomes, do I invest in my future or their misery?

I do, however the county told me they won’t get involved because it’s a civil matter. I should contact an attorney and have them send them a notice I will be using the access. Hopefully when they show it to their attorney, the attorney will advise them they will lose and to just grant me access. I’m curious what will happen if I just drive the access and tell them to call the sheriff if they have a problem. I have the survey and it clearly notes a road that they have eliminated.

So you can get to this property a different way? No, that is the access but nobody will enforce it without exchange of money, ie attorney fees, court cost. lol However, a 1.2 million dollar proposed project that will generate tax revenue and they will not only define the road but will pave it as well. lol

I'd spend my money on a surveyor and then a free call to the sheriff. I spent $900.00 to prove to another neighbor that his stand was on the wrong property. I’m about over neighbors and trying to be neighborly.

Maybe I missed it, but why do you feel you need to retain a lawyer ahead of time. If you have an easement, continue to use it to access your property. Don't do anything nefarious to harrass the other guy or screw with his hunting. Maybe you have to cut some firewood during deer season if he gives you problems.
But if you have an easement and can prove it, I don't see why you need to pay an attorney to prove it to the other guy. Go about your business. Because they turned the road into their front yard. I checked with the county to verify the road on the deed in fact was correct. I explained what has taken place and was informed if explaining it to them wasn’t accepted then I would need to take legal action as driving across their yard would appear to be just that and the sheriff would not enforce my right even with the survey map and deed showing a road.

It didn’t help the county agent was saying, “I’m sure they are loving it. Cutting off the road, living peacefully at “the end” of the road, probably hunting your property, treating it like it is theirs.” lol
If I have to pay a surveyor, as soon as the line against them is established I’m falling trees along that line to the point a 12 foot Indian won’t be able to see their property.

You really have no choice then. I'd visit them one more time, this time to explain that we either agree to something or they better get their wallet out too, because the lawyers will be sending letters.I Like I said above, your property value is nill if you can't get to it, even tho the deed says you can.
