Going to be interesting how that all shakes out. My grandmother was an Eastern Band Cherokee and some of her ancestral land is where Dollywood and Pigeon Forge now sits in east TN - doubt they're going to redraw any of those lines anytime soon..

The Wisconsin Historical Society and the Buffalo Bill Museum have both indicated they would like to have it. I'm at the point in my life it will most likely get sold at some point.
There's a ton of history on that thing. It even has the religious distributions of the U.S. counties and a ton of other stuff.

To open this can of worms, Just how many treaties were not honored in full, and our Native Americans wre just plain screwed over. Did the whites in the end break treaty and steal the Black Hills because of gold.think about how the uneducated last their tribal lands. My 2 cents.

it's a complex problem that falls more under corporate law than "the spoils of war".

In regards to current land ownership nothing will change.

Back in the late 1800's the land was broken up and each tribal member received a portion (~160 acres) of the land within their tribal boundaries. This made the individual member a property owner, free to keep, sell or lease their own land. On an aside, I'm not sure how this worked since Native Americans didn't receive US citizenship until sometime after the turn of the century.

The allotment program is the problem, not all of the land was allotted and remained under trust (by the govt/dept of the interior), therefore, federal jurisdiction. It may also be that allotments which were never sold, and remain in possession of the original family may be considered federal land.

On a final note, about the only time you see this issue is when some halfwit no account commits a crime that carries stiff penalties (25 + years or the death penalty) and the state throws the book at them.

It's one of those things that is so scarce there's really no track record of sales, so it's really tough to put a price on it. I think $5,000 is a good point to start, whenever I decide to let it go. We'll see how life goes.

I didn't read the ruling but articles I read seem to indicate it boiled down to whether the wording of a congressional act in the late 1800s was clear in dissolving an earlier act or treaty. 4 said it did while the 4libs and Gorsich said it did not. If this is correct it's a somewhat simple fix for Congress to pass a bill to clarify the language of the act in question.

Thanks! Been a source of a lot of learning and fun for me through good times and bad. When my first wife was grabbing everything she could get her hands on I told her "Touch my guns or my map and I will break your effing back." Shortly after I found my best friend and wife who loves the map as much as I do. That was 44 years ago.

The RR map I have is interesting in the fact that cars hadn't been invented and every town was on a railroad.
Correction. It is a 1922. There were cars, but not a lot of roads.

this is not about spoils of war. we are talking about a treaty. that is a legally binding document. think RULE OF LAW.

My limited understanding is that the crux of it is that land was ceded by treaty as part of the relocation from the southeast. The details of the treaty granted sovereignity to the muskogee nation. The muskogee would later allow ownership of large portions of that land to transfer to non tribal members. What was not transferred was sovereignity and a later attempt by Congress to clearly define that sovereignity had indeed been transferred was less than clear in its language. That is the point that was decided by SCOTUS.

I have no suggestions as to what you do with it other than make sure our history is preserved. I would'nt even give that opinion but for the climate we've seen lately with the crazies destroying what history they can get their mitts on.
