no they are warning you about a real thing everyone as of today is a felon if they have a braced pistol

and to top it off the E form 1 is a Trap you must provide all the evidence that you are in violation of the law and ask them to give you permission it is totally at the discrestion of the ATF to prosecute you or not you have to give them everything they need to prosicute you to fill out the application and then it is a deferred tax.

this is nothing but a strait up attack on the citizens for no public safety

safe options as I see them having been looking at this since Friday the 13th of January

take your short barrels to a relatives house who owns no AR lowers and no AR lowers are present or going to be present. or take them to your gun smith and ask him to clean them and take his time a long time. or if you own a cabin , just someplace were they do not share an address with a lower that you or any one you know is in possession of.

or take your short barrel and receiver to your friendly SOT have them "build" it as a SBR and form 4 it back to you , you pay 200tax wait who knows how long and whatever they charge you to "build" meaning engrave it

E form1 is a trap however from everything I am seeing

I am not a lawyer , the lawyers are also trying to figure this out and they may find a other options but

we will have to see how this gets litigated out


removing the brace and the barrel from the upper receiver might also be an option , you should consult your legal team

there is something the ATF has used that is 10,000% unconstitutional but it hasn't stopped them in the past called Constructive Intent
this is because you have the parts and they are at the same location you Intend to break the law
they may not get a conviction but they can fight you with your own tax dollars for a while.

Pretty much. But with the recent rulings SCOTUS has been handing down odds are AFT is going to get slapped down. However as evidenced by the blue states they'll more than likely double down on stupid and then more hurry up and wait.

Ultimately Congress will have to weigh in.

The form, 2274, you fill out for purchase is by law not a registry and is to be retained by the FFL seller in a "bound book". Its purpose is record keeping and for review by law enforcement should the need arise.

BTW, the guns used in crimes are traced via serial number not by registry of end buyer but from the other direction.
First to manufacturer, then to the distributor, then to dealer and the bound book he keeps. Each step is documented in a bound book.

However, if a FFL closes down or surrenders his FFL the bound book goes to the AFT. The AFT has been caught putting all of that data into their data base plus photographing bound books at FFLs. This type of data collection for an ad hoc registry is in clear violation of federal law as congress has specifically prohibited gun registries.

Also for many if not most of these pistols, particularly the AR ones, they began life as a stripped receiver and would be listed as such on the 2274.


4473 is the form number and to entice dealers into fewer visits electronic 4473 submission was the carrot dangled , so it gives electronic access to their books.
there were supposed to still be limits on accessing those records but ATF is basically bragging they have them all any time now.

ATF doesnt prosecute anyone. The US Atty office does. They may bring the blue jacket case over for review but doubtful anything will happen. they wont prosecute a darn thing down here unless some higher up political turd can get a photo op.

Another interesting legal factoid.

Standing.

This rule change was announced far enough back for the comment period, study and discussion of comments, then a period of posting to the federal register before going into effect. Months and months of time for a court to act BUT our courts have conviently waffles by saying no argument can be heard until someone is actually harmed or about to be harmed. So there's just one of the hurry up and wait things.

but it is all just words until the final rule is officially published to the national registry

if you recall a year ago they were talking about a worksheet to define traits that would have left a brace possible under certain circumstances.

so they started with one set of possible rules more than a year ago , but until 1/13/2023 there wasn't a real written document for any of it
even that got changes in the last few weeks

you are correct in that congress could have told AFT back off your over playing your authority and jurisdictions in this matter and did not.

Unless it comes with a 1.7 trillion dollar spending attachment, this congress will do nothing.
It will be up to the Supreme Court. Maybe it can be fast tracked.
