In today's world.
My wife works as a night nurse. 12 hr shifts. She gets off at 5:30 a.m. and sleeps in the daytime. The village blows the air raid siren at 12 noon and again at 1:00 which wakes her even with white noise and ear plugs
I've asked the village board to stop but they just laugh. Could this be discrimination? Maybe they should blow the siren at midnight and 1:00 a.m. so night shift knows its lunch time.
If village won't listen, what's the next step?

I think they do that in Kansas too. I asked and was told it was for the farmers. Let’em know when it’s lunch time and when it’s over.
I don’t think it’s discrimination unless they decided to start doing it once your wife got on night shift. I’d imagine it’s been a thing since the beginning of the “village”. She’ll eventually sleep through it.

Not without intent it is not.

Now if they purposely do so knowing of her and/or "class" specifics beforehand and targeted towards her "class" it would be discriminatory harassment.

However, this sounds more like a prior established practice without regard to anyone in particular.

Now you might have a case for nuisance. Nuisance being defined as an action that reduces or denies one's enjoyment of an expected right or privilege. In this case the peaceful enjoyment of her home and property.

An attorney would know the particulars in your state and just how to address it. But the hurdle you most likely will face is immunity. A neighbor can be sued for loud noises, governments tend to have immunity for governmental functions.

I would guess that the blowing of the siren is mandated by government higher up than the village. They blow the sirens her at noon on Wednesdays.

No, it is not discrimination, just unfortunate circumstance. However, it might be reasonable to question whether blowing the whistle still has a valid purpose. Perhaps do some research on when the practice was started, if an ordinance was passed requiring it, and if so, what the basis was. Also look to see if there is a noise ordinance that whistle blowing may violate and provide a basis for challenge if there is no longer a valid purpose for blowing the whistle.

You might have a better argument that it devalues your property. Someone might want to buy your house but once they hear the siren they decline the purchase.

That has been litigated with nuisance barking etc.

I wonder if it is one of those old Chrysler ones. Built with a 331 firedome hemi V-8. Supposedly loudest siren ever made. Reputedly 138db @ 100ft. Can be heard for 25 miles.

Only in America do we put a hemi on a siren.......lol

They used to blow the whistle in a little town where my aunt lived and I would stay there once in a while. It wasn't the whistle so much but every dog in town would howl for 15 minutes afterward just at one another.

I know in one town that I live close too they don't blow the fire siren after a certain time in the evening so it doesn't wake/bother people.iam not sure if it still goes off at noon or not.

night shift always gets pooped on , it is a day walkers world.

run by people who work 8-5 or there about

but night shift workers are not a protected class

and they are not one race , color , creed , sex .................................................................................................all the other stuff the put in a non discrimination statement

not sure if you say they use it as a noon and 1mp whistle every day , or if they run regular tests at noon and 1

tests fall under the for the public preparedness safety

using it as a lunch start stop is probably just tradition in your town

where I grew up noon for lunch and 9pm for curfew for kids it was just a short siren for those

Well I am going to tell trains they can not blow whistles at road/rail crossings even though it is federal law to do so.

oh wait my Name isn't Madison

depends on the day but 1-4 trains a night pass my house about 200 yards away they lay on the horn for about 2 miles

I was just on the Mississippi along highway35 1-4 trains an hour there , I hardly even notice them while sleeping

maybe that it is just such a common thing we got used to it years ago

Way to take the bull by the horn instead of just complaining about it. you can alwasy tell when some one new moves to town
the complain about the siren always going off

why do we need that

well we though about making all the relators issue a statement that the siren would go off with every fire call to keep outsiders out , but they don't tell people so then they complain and we tell them to move back to Fib-landia where they belong.

Oh new people always complain about the train horn as well , we tell them to get over it and move out as well.

We also tell them to get over the night shooting also.

they are all free to go back where they came from that was soooo much better they decided to leave.

There's a lot of things in life that I don't like, or disrupt my schedule. But they're not discrimination.
Here we have a noon whistle and 6 p.m. one. Every town and village does it. When I worked 3rd shift it would wake me sometimes and then I would go back to sleep or not. I didn't let it ruin my day or think I was being discriminated against. While I do feel for her. Like many things in life she would be better off turning it into a positive. Maybe time for a bathroom break and then back to bed.

That's very true! And when depending on nurses to save people's lives, it doesn't matter if they have slept or not. Life is cheap!
And they don't even blow the siren here for fires. Every fireman has a radio and a cellphone.

Having the whistle as an air raid siren during the cold war makes some sense. Blowing it at noon and 1:00 PM has no reasonable association with it being an air raid siren. I suggest you keep digging into the reasons for the whistle sounding. You are not going to get anywhere challenging the practice unless you are willing to do the work.

Go to a council meeting and voice your issues.
The rest of your neighbors may feel the same, or just wonder who is complaining about it.
Other option, move further from the siren.

Have they always blew the air raid siren or did they start it after you moved there?

I don't know how folks in the city can get thru life without sirens to tell them when to get up, when to go to lunch, when to go back to work, and when to go home from work. They must have some electronic device they carry in one hand all day long so they know when to move. Too bad country folks don't have them things too.
Yes, I am talking to the village board members. Their theory is to keep doing things the same as the last 100 yrs. New thinking is beyond their realm.

If you can reach the siren a can of spray foam should be good for a couple peaceful days.Does it appear bulletproof?

Oh it's very accessible and I know what to do. I had some electrical training in Army and the firemen here can set it off remotely. Not going there though as that could bring prison time.

It's been here since about 1950...but the outhouses have been here longer than that. We should still use them too.

I know it sucks for night shifters, it's hard enough to try and sleep during the day anyhow, at least it was for me when I was on it. I doubt you'll get very far having them change it. It's the same here and the town I live in is about 6000 people. I normally work 2p-10p so it's a non issue for me.

Were you unaware when you moved where you did that this was a 80 year old custom? They blew the whistle at noon every day in all 13 towns in the county I grew up in and 40 years later your complaint is the first I ever heard of regarding this very popular tradition.

You think that's bad, you ought to try living 100 yards from a very active train track with a crossing less than half a mile away on either side. Morning, noon, and night, that whistle howled twice, every 30 minutes. You either learned to sleep through it.. or bought ear plugs.

You must be younger than I thought, because I assumed you were too old to be part of the the entitlement generation, but apparently not.

When I was growing up, the town fire dept blew the whistle at 6 pm and whenever the fire trucks were going out on a call. For the fire call it notified everyone that the trucks were going to come out of the station like bats out of He** onto a busy 4 lane. That made good sense and traffic would pull over at the sounding to avoid getting run over. I don't know the purpose of the 6 pm sounding but it let everyone set their clocks to a common time and may have been a daily test of the whistle. As I keep telling you, you will get nowhere until you find out why the whistle is being sounded and are able to show it is no longer valid. Go in to a town council meeting with facts. Keep them to yourself until the meeting. Chances are very good the town council members will not know the facts.
