Family calls with money issues. This time It's a raw deal 100% not a thing to do with him. It's hard to understand it can happen but They have him in the system due to his past drug issues. He has had things really straitened out a few years now and doing very well.
But our great Justice system has some video and I guess he matches the AI as the suspect. so they put out a warrant on him. He has never been in that county in his life It's 4.5 hrs away and he was at work and then at his parents on the days in question. Calling the prosecutor he was told get a lawyer and they strike the warrant intelligence they hear from the lawyer. The recommended lawyer wants $7500 half down to start.
NOW A TON OF bad life choices have put him in the position he is in with the felonies on his record and he also has not saved his money. BUT this is mind blowing to me that a prosecutor would not even look into this before putting out a warrant. Like call his boss and see he worked tell x then his Parents where he at dinner and helped his dad out with some things because he is still willing to from the prostate removal a few weeks back. Rather have him locked up 3 months
So there will be no bond and 90 days in jail before he see a judge and gets appointed a crap state lawyer before they even look into things. It's a railroad racket. Probably not 1000$ worth of billable hours if that and the lawyer wants that much! That the legal system is so darn messed up they won't look at a mandatory location on the other end of the state before wanting to lock them up 3 months. it's mind blowing. .
The best part is I just dumped money into investments and farm projects while I have been off and am much lowere on cash than I want to be. And I know I won't see it back fully and if so for over a year or 2 if I do.
The kid has had problems especially when he got back from Afghanistan. And he is finally lined out. He just had surgery on his shoulders that got tore up in Afghanistan last week and is supposed to be laid up a few months so can't work. I can't wrap my head around the prosecutor or lawyer.

It's my Brother in law. He got messed up with drugs when he got back dealing with not only the fall out of heavy combat, having friends bleed out in his arms, killing at least 42 people, and many of his buddies killed themselves when they got back. There was a time I would not let him at my house because of how people's brains work when on drugs. The last several years he has really been on track has a good job as a diesel mechanic, working side jobs every day he has them and doing very very well.
. It has something to do with theft. Sometime around 8pm. he got off work at 330 went to his parents to help out and dinner tell about 530. Went home and had a few beers with his land lord tell 7 when he was out feeding the cows with him so has someone to verifying where he was and when . He is 4.5 hours from where it happened and no way possible to have enough time to have Done it and no there is no question in my mind he has nothing to do with it.
And yote trap yes I work a lot and have made over 127k so far this year. But I also have put 43k into retirement accounts and just dropped 15 k out of savings in the last two months. Paid 38 k in income and propert taxes.So my savings is very low compared to normal. Yes I'm going to help him..
I have 2 issues 1. They will lock him up without checking out if he was even in the area. 2. It going to cost $7500 just to simply get a lawyer so he can hopefully avoid getting locked up loosing his job and house just to prove he was 4.5 hours away and has nothing to do with it.
our system is completely jacked up. The lawyer did say something about likely being able to sue the state over it. But that's just another tax on tax payers If he wins anything. no accountability for the state.

Contact the VA. Contact your local VFW Post, and ask for info about how to contact "The Kaufman Fund". This is and organization of Vets that help Vets with all kinds of problems, and no finances. ie: medical, dental, & LEGAL. They have a network of Doctors and Lawyers that will work Pro Bono, ie: FREE. I will check this post tomorrow and will be able to post a phone # and Email for you.

After he is cleared I would make sure the folks that elected that prosecutor know about this crap.

Sounds like part of the story has a hole in it. First no DA is going to issue a warrant UNLESS a detective or another police officer request it. SOMETHING has to tie him to the crime or HOW DID THEY GET HIS NAME !!! Google felons and he pops up?. Bam go get him. MMMMM something else burning on that stove....... something about a video and AI recognition I'm guessing a poor quality video and running that through the system. Also 3 girls involved he does not know. I'm sure it will get lined out it will just cost me a bunch of money And the family a lot of sleep. Years ago a guy took a swing at me. It didn't have the outcome he thought it would. I ended up with assult6 charges and sitting in court for defending myself! Now I did get a little carried away with blind rage but all it took was paying a lawyer a few thousand and everything got dropped. I felt like that was by but At least I was involved and not on the other end of the state.

I am sorry to hear about your BIL having to sit 90 days. I always like to play Devil's Advocate though. What if this were someone else and they WERE guilty? Would you want them back out on the streets for 90 days waiting to go to trial? Something just seems "off" on all of this.

I am sorry to hear about your BIL having to sit 90 days. I always like to play Devil's Advocate though. What if this were someone else and they WERE guilty? Would you want them back out on the streets for 90 days waiting to go to trial? Something just seems "off" on all of this. They have not picked him up yet. Only found out about it when they went to his parents to pick him up. He was not there having moved not long ago. He is hoping to get a lawyer to get the warrant receded so he doesn't have to sit. Now I'm just going off what I'm told but besides my belief with the time line I have been given its impossible for him to have been involved. If not for his divorce and soon to be cheating X he would be in much better shape financially.

Never heard of Anyone knowing how long they sit before going in front of the judge or hearing. Heck figured he be in court in a week. But good luck It is what the prosecutor and lawyers told him when he called them. I have no experience with the court system other than the one time I spoke about above and have no idea how it works.

I asked about that and was told won't get one until he gets in front of the judge and that would take 90 days. if he did not have representation? The warrant is a no bond warrant likely because of his past issues and having not shown before years ago. He did make a lot of bad choices years ago as I said. My wife's Grandmother is a very well educated business woman and found another attorney and they called that one.. She looked things up and found out more. She said I guess they ran facial recognition and she picked his pict out of a line up of pictures the computer spit out. The lawyer said that's nothing and there is a huge amount of crime in that area. So I know a little more info. He is still going to contact the VA but I told my wife to Take care of the attorneys down-payment when he Dec which one and what he wanted to do. That way if she can't get ahold of me .when I'm at work or driving home it gets taken care of. That one semester like she could get it in court Monday so ho I will know more about a plan by this time tomorrow if that what he decides to go with. I like she got more info so like the one to go with but it's not my choice it's not my life only thing of mine on the line is some cash.

I believe he has a right to counsel before ever seeing a judge. If he truly does have an airtight albeit, I would seek a Public Defender.
