I asked my accountant about this and he wasn't real sure about it, thought I better check with the Experts here.

Anyone used a section 180 to write off excess nutrients in land you purchased? I've heard some pretty bold claims, my advisor told me not to count on the claims being advertised. Anyone with experience?

I found this slide show by Iowa State University, if anyone is interested.
I've had enough run arounds with the IRS to know I don't want a repeat...

The link may be helpful as well. You state AG department or FSA office can give you the info on what a typical crop will use as nutrients in your area.

The more I read the less I doubt it will work for me, we're going to pasture cattle on ground coming out of CRP

Did you mean to say.......... The MORE I doubt it will work for me ???

I am far from conversant on this subject but....it would seem to me that if the ground you are looking to expense was in CRP...
is there any residual nutrient there to begin with ? Was it ever fertilized ? If it was fertilized prior to being CRP....how much of that applied nutrient is left ?

If not, it seems sketchy to me to try to claim an expense. Just spitballing here.

Soil tests will tell you if you are above, below or at typical levels for that soil type and standard crops. I would doubt much that with a CRP history that you will be much if any over the range for typical nutrient levels.

Yes, I misspoke. I don't believe this is worth pursuing in my case. I've gone rounds with the IRS already and they don't play fair, I'm not doing anything to risk doing that again and ending up in the crosshairs of the worst people I've ever dealt with who hold enormous power.

Probably a prudent decision.
