How does one proceed with pursuing a case of medical malpractice.

Without divulging details a surgeon performed an unwanted procedure as part of another one that was needed. The needed one worked as intended, the unwanted one created a major medical issue not easily corrected. To compound things no other surgeon has been willing to touch or even go into detail about it.

a lawyer who specializes in such cases would be the best place to see if they think the case has merit.


America only has one issue, we have a Responsibility crisis and everything else stems from it.

I know attorney but what should I look for?

One of the billboard/TV ad ambulance chasers or something else?

What should I be documenting and preserving now?

Med Mal lawyers are NOT ambulance chaser/billboard attorneys. It is a very specialized field of law and successful cases require not only a high degree of competence, they almost always hinge on the level of professional testimony from medical experts to connect the harm caused with the physician's negligence. Be aware that because of the strength of the medical professionals' lobbying power, most states have very doctor-friendly rules and statutes. For example, some states require you to proceed first to a medical-legal screening panel before filing suit; other states have very short statute of limitations periods in which to file your claim. The best advice is to see a competent attorney as soon as possible and go from there.

Thank you, that is exactly the advice I'm asking for. So do I call the "one call" ones or the local guy by the courthouse. I know I need a specialist but I don't subscribe to the courthouse newspaper so I dont know just who is winning or settling or making things right.

For the record, I want things fixed and restored to the best possible not a cash go away deal with it thing.

I'm not even sure yet if things have gotten to legal filing stage, I haven't even gotten to the raise heck with the hospital staff yet. Actually the nurses and staff have done the best they can.

You can:
1. Do a Google search of medical malpractice lawyers in your area or
2. Call your state Bar association and ask them for a referral to a med mal lawyer.

Most of the ones you hear advertised are not even lawyers, they just originate leads that they then sell to law firms. Of course they get a healthy cut of any settlement.

I just caled a lawyers office that advertised fro medical lawsuits, talked to the secrarary and explained the case. She said they would look iy over and see if there was a case they woud get in touch. I didn't have a good enough case, but yours might

Very good advice. I know because I had a similar situation. Everything is as Lazarus has stated. Your average "run of the mill" attorney doesn't specialize in medical malpractice. There are some that do. When and if you find one that takes your case they have medical experts they work with.


You know you're old when you walk past a rest room and think, as long as I'm here........
