If so, execution take over a decade to do. There's usually numerous appeals before it happens even then the date takes a long time to get.

He will be death row eligible based on Texas Law. I have a good Idea as to why they are only filing five murder charges and not Capital Murder. he is gonna get hit with numerous Federal charges and then the state will refile their charges to Capital Murder.

Hair Sniffer bused him to Jacksonville Florida in the middle of the night where he immediately broke into a home amd Murdered the Daughter and her Boyfriend and the Father, He stabbed them to death and was found Passed out Drunk in a bed. The Mother worked a Night Shift and came home to the Carnage. She called the Police and that is where they found him and his Bloody knife, he too will be tried and they are pushing for the Death Penalty. I thought Hair Sniffer took an Oath to protect the citizens of this country!!!!

I havent heard as of this post whether they arrested anyone else at this point. It depends if the home was occupied at the time, they will be sorting out that part in the coming days. I am fairly certain that with the number of federal LE involved, he will be indicted by a Federal Grand Jury in Beaumont as expeditiously as possible. I can think of at least 40 counts at this point in which he will be indicted. Beaumont has two Federal Grand Jury sessions each month.

The reason I feel like this is the path they will take at this point is due to them filing the 5 counts of murder, a 1st degree felony 5-99 or life. That is just to hold him for now. ICE most likely worked all night to seek a magistrate to issue a detainer on him for the illegal reentry, which is a felony due to his previous deportations. When that occurs, he will not be eligible for bond. Once they refile the state charge(s) for two counts of Capital murder, he will not be eligible for bond on those charges. The reason they should file the two counts of Capital murder is due to the fact that he killed a child under the age of 10, which according to our Code of Criminal Procedure, can be filed additionally to the murders of the other four persons. The indictment for those four will fall under the statutory provision for the murder of two or more persons during the same criminal episode. The US Attorneys Office will not, or it is highly unlikely for them to pursue indictments for murder, as the maximum sentence in the Federal Guidelines for sentencing is 20 years.

What I would love to be able to see is when his deportations occurred and why he wasnt prosecuted for felony reentry for all subsequent unauthorized border breaches.

All who are complicit in the open border fiasco should be publicly beaten by the family of those who died, due to their failure to honor their sworn oath.

Sheepdog I read both of your posts on it, but still am not understanding what the point of filing the lesser murder charge now, and then filing harsher ones once the feds issue charges is. What would be the problem with filing the strictest charges from the start?
