I'm confused. Are states trying to remove trump from the ballot on the premise that he caused an insurrection and therefore is now unqualified? But he hasn't been convicted off these accusations correct? Is this due process James?

There was a trial in Colorado on the insurrectionist issue. Trump participated, and had the chance to offer evidence and cross-examine witnesses against him. He also was heard on appeal. He got due process. And he lost.

I don't believe the Colorado decision will withstand US Supreme Court's review, but I doubt they'll reverse for lack of due process.

Btw, Section 3 of the 14th Amendment doesn't describe a crime. It sets out a qualification to be president; like elsewhere the Constitution provides that you must be native-born and 35 years of age or older.
