Lease trophy hunts.
Claim animal damage to crop insurance.
Cut the remaining corn in April.
Thumb nose at Comish and regular hunters.
Tell that this is legal and you poachers whine too much.

They definitely can. Open fields doctrine is alive and well in Wisconsin.


I talked to my local Warden, and he said they have the right to go on any private land as long as they have a reason to be there. They just can't go willy Nilly on private land.

After regulating farmers out of farming and turning thousands of acres into wind and solar 'farms' seems like a lot of government entities are scrambling to justify their existence Maybe we are going to have the Dept of apple sugar beet and carrot Inspection in Mich.

In Missouri - only the government can bait deer and then use the CWD excuse to kill tens of thousands of them while they have developed fawns in them.

Oh, and I did run the numbers - of those killed for CWD reasons - less than .01% of them were positive for CWD.

Part of the problem in the Tn court case was that the warden's reason for entry was that hunting was going on. That strongly suggests a LE philosophy that hunting laws are being broken just because someone is hunting. That mindset strikes me as wrong. The other problem was that the Tn state constitution does not allow the open fields doctrine to be used to justify a LE entry onto private property to search for evidence, a warrant is required just like any other property search.

Baiting or using timed feeders in TX allows for predictable deer movement. This serves the many thousands of modern-day hunters who have a very narrow window of opportunity to be in the field, but are willing to spend significant sums for the chance to harvest a quality buck. Their financial contributions go far in providing improved nutrition, genetics, and habitat management...a giant industry in TX. You or I might not choose the same hunting tactics but, great majority of hunters who support the trophy whitetail industry here rely on feeding deer (for predictability & supplemental nutrition).

IMO-based on sound science, CWD is not a serious threat to white-tailed deer. It is of real concern to elk, red deer, and mule deer. Controlling spread of CWD is not a valid reason to prohibit feeding whitetails...such prohibition is another ploy to restrict hunting practices.

In every state that I have worked in, game wardens (state & federal) need only "probable cause" to enter private property to investigate potential violations. This cause is well established & recorded before entry. This also pertains to high-fenced enclosures. I don't know how that is changing in some individual states, but taking that power away from LE may come back around to your disadvantage when trying to prosecute offenders.
