In Illinois if your standing on your land facing the line/property fence you have what's on the right and your neighbor maintains what's on your left providing your in the middle of the property line.iam not sure how true it is here but I've heard if you don't own cattle you do not have to maintain the fence any longer there was a dispute between 2 landowners little over a year ago in our township and never did hear how it turned out.

If it's on your side of the line you're free to cut it. If the trunk is on or straddles the line it can't be cut without mutual agreement is how it is in practice here. Don't know the specifics of the actual law regarding if limb trimming causes death of tree on the other side though. Actual line trees tend to become permanent witness trees.

Sorry I misread. I see it is encroaching on your property. Id spray it with straight tordon and let the courts figure it out.

In Ohio, you can legally cut any brush, trees or plants 10' from the property line, to put in or maintain a fence. I doubt it always goes over well when someone just does this.

To the right as stated and do you need to maintain the line fence if and when you do not have livestock----- it many times depends on the juristiction you live in. Here in WI which had over 100,000 dairy farms the famer did have to maintain a line fence.

A local fella went around the perimeter of his land with an excavator and ripped off the half of the hedge trees on his side. Just got me thinking. It seems cutting hedge posts is too hard of work anymore and trees are getting too big for anything but firewood.

It's been awile since I've been told but I believe it's the same in Montana, face the fence you have the right they have the left. We are not required to fence our cows in but you are responsible if you don't want to be free feed

I know a lady here that her driveway was along the fence to her house. Probably 10 or 15 feet from the actual fence itself. There was some trees that were growing right on the fence line, some on one side and some on the other. Well the limbs were hanging down and scratching here vehicles so she trimmed the limbs out of her driveway. Well the neighbor got mad and sued her. The neighbor had the property surveyed and like I said some trees were on her side of the fence and some weren’t. The lady ended up having to pay $10,000 in damages to the neighbor for trimming up the branches that were over hanging her driveway.


Anyone that owns a gun and votes democrat deserves to have there gun taken, cause they truly are too stupid to own a gun.

Right half, but if you don't have livestock on your side and they do, it's more their responsibility.
