Im going thru a divorce and I would like to keep the house but I dont want the taxes to go up. We have a good idea what the house is worth but I dont want to get an appraisal to make the taxes go up for me. Both our names are on it. Can she just sign off of the title? How does this work. In Illinois.

I think property taxes are based on an assessed valuation, not an appraised one.

BUT…check with an attorney before you make any decisions based on what a bunch of trappers say.

Yea I cant talk to them for two more weeks. I just thought maybe someone would have gone thru this.

I believe in most places you can change the deed without an attorney, there is a form for change of deed in whatever agency stores the deeds, probably a county clerk....you both need to appear and sign, you can call over there to see if it's possible in your state before you see the attorney, which is still a good idea anyway

Here you pay someone to appraise the house. For your taxes to go up the appraisal company would have to report your appraisal to the county auditor. Which they don't do. Your taxes go up when your county auditor goes around and tells everyone their house is worth more than it used to be. The county should be none the wiser if you ask someone for an appraisal.

A divorce is whatever you both agree to. If she agrees the house is worth 100k and accepts a check for 50k then no appraisal is needed. Now if she thinks you getting one over on her she may require an appraisal but its whatever you get her to agree to appraisal or no appraisal... Don't tell her you'll give her half, have it say you'll give her 50k or whatever dollar amount without a %... and have her agree to it / sign it... and its a deal and a deals a deal.

Generally property taxes are based upon recent valuations of similar properties in the area. In short, recent sales of like property as reported when sale deeds are filed.
That is the only real mechanism most county tax assessors have available to them. What did something similar sell for and their records on file.

Private appraisals are not recorded at the courthouse unless they are entered into the record in some other legal matter but then would only exist as evidentiary testimony not an actual record of sale and would not be accessible for tax purposes.

However, in a tax appraisal contest where it goes to court or arbitration a private appraisal, if known to exist, may be subject to subpeona for evidence. I imagine that it could in any legal proceeding where value is being contested.

When your getting a divorce, a lot can happen in 2 weeks. Talk to your attorney and tell him what you want. Remember you are now in a legal situation.

If both your names are on the mortgage, it may not be as simple as you'd like to think. Make sure you with work through your attorney, accountant, and financial advisor as there are a lot of considerations in regards to debt and wealth.

She already has a lawyer, she's getting legal advice and he should also, not from Tman but from actual lawyers.

I don't know about Illinois but here in Montana you can just file a quit claim deed . That's what I had to do (twice) . Just pay them what portion they have in the property and no mess. I went with an attorney to make sure no loose ends I know that the divorce laws are different here, Montana is not a community property state but I think Ill. is. When my sister who still lives there had a divorce her ex was able to get half the down paymen even though he didn't have a cent in it, but not happening here

The would depend on how Peed off she is with you. Some women can be brutal in a divorce.
